Request for Proposals (RFP) received February 17, 2022 for S76-T30030 - Approve an ordinance awarding a contract to Morris & McDaniel, Inc. in the maximum contract amount of $3,589,400.00 for promotional testing and assessment testing services for the positions of Fire Captain and Senior Captain for the Human Resources Department.
Specific Explanation:
The Director of the Human Resources Department and the Interim Chief Procurement Officer recommend the City Council approve an ordinance awarding a two (2)-year contract with three (3) one-year options to renew to Morris & McDaniel, Inc. in the maximum contract amount of $3,589,400.00 for promotional testing and assessment testing services for the positions of Fire Captain and Senior Fire Captain. The Director of the Human Resources Department may terminate this Agreement at any time by giving 30 (thirty) days written notice to the contractor, with a copy of the notice to the Chief Procurement Officer.
The scope of work requires the contractor to provide turnkey services related to promotional testing for the rank of Captain and Senior Captain and ensure all components for the Houston Fire Department (HFD) Captain and HFD Senior Captain promotional process are legally and professionally defensible and are in compliance with the December 19, 2012 Interim Article 11 Agreement to the 2011 Collective Bargaining Agreement (CBA) between the City of Houston and the Majority Bargaining Agent (MBA) as well as Chapter 143 of the Texas Local Government Code. The contractor will develop and perform all work, job analysis and validation for the HFD Captain and Senior Captain exams, their compositions, book selection, development, administration, grading, as well as review of and response to all appeals filed by the candidates as required by the CBA. The job analysis shall be prepared under the supervision of professionally qualified personnel (Professionally qualified personnel shall be deemed to be an individual(s) with at least a Ph.D. in Industrial/Organizational ("1/0") Psychology).
The RFP was advertised in accordance with the requirements of the State of Texas bid laws and as a result, proposals were received from Morris & McDaniel, Inc. and 10 Solutions, Inc. The evaluation committee consisted of employees from the Houston Fire Department and Human Resources (HR).
The proposals were evaluated based upon the following criteria:
1. Responsiveness of Proposal
2. Technical Competence
3. Price Proposal
Morris & McDaniel received the highest overall score and was deemed to be the best qualified firm to meet the requirements as outlined in the RFP.
M/WBE Subcontracting:
The RFP was advertised with an 13% goal for MWBE participation. Morris & McDaniel, Inc. has designated the following company as its certified MWBE subcontractor.

Pay or Play Program:
The proposed contract requires compliance with the City's 'Pay or Play' ordinance regarding health benefits for employees of City contractors. In this case, the contractor provides benefits for some employees but will pay into the Contractor Responsibility Fund for others, in compliance with City policy.
Hire Houston First:
The proposed contract requires compliance with the City's 'Hire Houston First' (HHF) Ordinance that promotes economic opportunity for Houston businesses and supports job creation. In this case, Morris & McDaniel, Inc. does not meet the requirement for HHF designation, therefore the HHF preference was not applied to the contract award.
Fiscal Note:
Funding for this item is included in the FY 2023 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
