RECOMMENDATION: Approve First Amendment to the construction contract with Gadberry Construction Company, Inc., and appropriate additional funds.
SPECIFIC EXPLANATION: On April 28, 2021, by Ordinance No. 2021-319, City Council awarded a Construction Contract to Gadberry Construction Company, Inc. in the amount of $4,137,000.00 to provide construction services for the Kendall Neighborhood Library and Community Center Restoration (Harvey). Over the course of construction, cost escalations, supply chain issues and several unforeseen field conditions have significantly impacted the project cost and schedule, extending the original substantial completion date 9 months.
Therefore, the General Services Department (GSD) recommends that City Council appropriate the sum of $248,220.00 out of the Miscellaneous Capital Projects/Acquisitions CP Series E Fund to the contract with Gadberry Construction Company, Inc. to continue services. It is further recommended that City Council approve a First Amendment to the construction contract with Gadberry Construction Company, Inc. to increase the director’s authority to approve Change Orders up to 16% of the original contract price, which will exceed the original 10% contingency.

DISASTER RECOVERY NOTE: This item is related to the impact of Hurricane Harvey DR4332, and it is the City’s intent to seek reimbursement from the Federal Emergency Management Agency (“FEMA”) and other eligible sources for such expenditures.
M/WBE INFORMATION: The original contract has a 19% MBE goal and 11% WBE goal. To date, Gadberry Construction Company, Inc. has achieved 19.1% MBE and 0% WBE participation. It is anticipated that Gadberry Construction Company will achieve the goal by the completion of the contract.
FISCAL NOTE: No significant Fiscal Operating impact is anticipated as a result of this project.
