SUBJECT: First Amendment to the Professional Engineering Services Contract between the City and HR Green Inc. for Wastewater Operations (WWO) Engineering Support Services.
RECOMMENDATION: Approve the first Amendment to the Professional Engineering Services contract with HR Green Inc. and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the city’s ongoing program to improve inefficient components of existing wastewater treatment plan and sewer collection system. The work to be performed under this contract is necessary to maintain compliance with Houston’s wastewater consent decree with Environmental Protection Agency (EPA) and Texas Commission on Environmental Quality (TCEQ).
DESCRIPTION/SCOPE: This project consists of providing professional engineering services and staff augmentation assistance as required for the administration, design, and construction management of wastewater collection and treatment systems, including project management, as needed for various assignments. Professional staff may include civil, process, mechanical, structural, electrical, and instrumentation & controls engineers, scientists and/or technical staff (project management, construction management, and construction observation support).
LOCATION: The projects are located throughout the City of Houston.
PREVIOUS HISTORY AND SCOPE: City Council approved the original contract on January 27, 2021 under Ordinance No. 2021-0058. The scope of services under the original contract consisted of staff augmentation and/or perform Phase I - Preliminary Design, Phase II – Final Design, Phase III – Construction Phase Services and Additional Services as applicable to each assignment (work order). Under this Contract, the Consultant has been authorized to perform eleven (11) work orders covering a wide range or duties from staff augmentation to design and planning for projects tied to the Consent Decree.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the first Amendment, the Consultant will accomplish the following: Continuation of staff augmentation and wastewater collection system assessment using Sewer AI software to comply with Consent Decree requirements. A fee of $3,000,000.00 is budgeted for Basic Services. Any assignment may include certain Additional Services to be paid either as lump sum or on a reimbursable basis as part of that assignment. As a result, no special appropriation for Additional Services is included.
The total cost of this project is $3,150,000.00 to be appropriated as follows: $3,000,000.00 for Contract services and $150,000.00 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24%. The original contract amount totals $3,000,000.00. The Consultant has been paid $1,655,881.00 (55.20%) to date. Of this amount, $486,397.00 (29.37%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $6,000,000.00. The Consultant proposes the following plan to meet the M/WBE goal.
