ORDINANCE awarding contract to RBEX, INC dba APPLE TOWING CO. for Towing and Storage Services for seized vehicles for Houston Police Department, providing a maximum contract amount - 3 Years with 2 one-year options - $1,433,203.75 - General Fund

Background:

Formal Sole Bid Received June 30, 2022 for S10-L31286 – Approve an ordinance awarding a contract to ­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­RBEX Inc., d/b/a Apple Towing Co. in an amount not to exceed $1,433,203.75 for towing and storage services for seized vehicles for the Houston Police Department. 

 

Specific Explanation:

The Police Chief of the Houston Police Department  and the Chief Procurement Officer recommend that City Council approve an ordinance awarding a three-year contract with two one-year options ­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­to RBEX Inc., d/b/a Apple Towing Co. ­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­­on its sole bid meeting specifications for towing and storage services for seized vehicles in the total amount not to exceed $1,433,203.75 for the Houston Police Department.

 

This project was advertised in accordance with the requirements of the State of Texas bid laws.  Thirteen prospective bidders downloaded the solicitation document from SPD’s e-bidding website, and one bid was received.

 

Subsequent to the receipt of the bid, prospective bidders were contacted to determine the reason for the limited response to this solicitation. The primary reason for limited interest was that bidders determined that they could not meet the demand of requiring to have a minimum number of light, medium, and heavy-duty wreckers at its disposal for any given time.

 

The scope of work requires the contractor to provide all labor, supervision, parts, materials, tools, equipment, supplies and transportation necessary to provide towing and storage services for vehicles being seized by the City of Houston Police Department, where the contractor shall maintain at least ten (10) approved light duty wreckers, one (1) medium duty wrecker, two (2) heavy-duty wreckers, and six (6) roll-back wreckers for all types of towing, maintenance and jump-starting vehicle services 365 days a year.

 

M/WBE Participation:

This invitation to bid was issued as a goal-oriented contract with a 7.44% goal for M/WBE participation level.   RBEX Inc., d/b/a Apple Towing Co. has designated the below-named company as its certified M/WBE subcontractor:

Pay or Play Program:

The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors.  In this case, RBEX Inc., d/b/a Apple Towing Co. shall provide health benefits to eligible employees in compliance with City policy.

 

Hire Houston First:

This proposed contract requires compliance with the City’s ‘Hire Houston First’ ordinance that promotes economic opportunity for Houston businesses, while supporting job creation.  In this case, RBEX, Inc. d/b/a Apple Towing, Co.  is a designated HHF company, but they were the successful awardee without application of the HHF preference.

 

Fiscal Note:

Funding for this item is included in the FY23 Adopted Budget.  Therefore, no Fiscal Note is required as stated in the Financial Policies.
