The Director of the Houston Parks and Recreation Department requests Council approval of an amendment to an existing contract with SPARK, Inc. (“SPARK”). If approved, the amendment will increase the maximum contract amount and extend the term of the agreements for an additional 5 years to December 19, 2028.
SPARK is a non-profit organization that funds improvements at public schools for public use during non-school hours. On December 12, 2018, pursuant to Ordinance No. 2018-0994, City Council approved and authorized the original agreement with SPARK for the management and construction of improvements to certain school playgrounds as public parks and recreational facilities. To date, a total of nearly $300,000.00 has been paid to SPARK from funds budgeted to the Council District Service Fund.
The requested increase to the maximum contract amount is $370,000.00 to a total maximum contract amount of $670,000.00. This will facilitate payments to SPARK totaling $67,245.00 from funds previously allocated in CDSF for the nine projects listed below. The increase will also allow for additional contract capacity for future CDSF allocations to SPARK.

Fiscal Note:
Funding for this item is included in the FY2023 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
Pay or Play:
The Agreement requires compliance with the City's Pay or Play ordinance regarding health benefits for employees of City contractors. The Firm provides health benefits to eligible employees in compliance with City policy.
MWBE Subcontracting:
The Office of Business Opportunity has approved a waiver because the contract does not exceed $1,000,000.00.
