Summary:

ORDINANCE finding and determining that public convenience and necessity no longer require the continued use of a 6-foot-wide waterline easement and an 8-foot-wide sanitary sewer easement, all being out of Lot 8, in Block 3 of Broad Oaks, located in the Charles Sage Survey, Abstract 697, Houston, Harris County, Texas; abandoning the easements to Neal Gittleman and Cathie Gittleman, the abutting owners, in consideration of their cash payment to the City of $3,100.00, and conveyance to the City of a 15-foot-wide sanitary sewer easement, also being located in the Charles Sage Survey, Abstract 697, Houston, Harris County, Texas, and other good and valuable consideration - DISTRICT G - HUFFMAN

Background:

SUBJECT: Ordinance authorizing the abandonment and sale of a 6 foot-wide water line easement and an 8 foot-wide sanitary sewer easement, in exchange for conveyance to the City of a 15 foot-wide sanitary sewer easement, all within Lot 8, Block 3, out of the Broad Oaks Addition, out of the Charles Sage Survey, A-697. Parcels SY19-072A, SY19-072B and DY19-039

 

RECOMMENDATION: (Summary) It is recommended City Council approve an ordinance authorizing the abandonment and sale of a 6 foot-wide water line easement and an 8 foot-wide sanitary sewer easement, in exchange for conveyance to the City of a 15 foot-wide sanitary sewer easement, all within Lot 8, Block 3, out of the Broad Oaks Addition, out of the Charles Sage Survey, A-697. Parcels SY19-072A, SY19-072B and DY19-039

 

SPECIFIC EXPLANATION:

Neal Gittleman and Cathie Gittleman, the underlying property owners, requested the abandonment and sale of a 6 foot-wide water line easement and an 8 foot-wide sanitary sewer easement, in exchange for conveyance to the City of a 15 foot-wide sanitary sewer easement, all within Lot 8, Block 3, out of the Broad Oaks Addition, out of the Charles Sage Survey, A-697. The applicants plan to incorporate the abandoned easements into their property for future addition to the existing single-family dwelling.  The Joint Referral Committee reviewed and approved the request.

 

Neal Gittleman and Cathie Gittleman have completed the transaction requirements and have accepted the City's offer.

 

The City will abandon and sell to Neal Gittleman and Cathie Gittleman:

 

Parcel SY19-072A

652 square-feet water line easement:                        $26,080.00

Valued at $80.00 per square foot x 50%

 

Parcel SY19-072B

869 square-feet sanitary sewer easement:                 $34,760.00

Valued at $80.00 per square foot x 50%

 

TOTAL ABANDONMENT AND SALE:                       $60,840.00

 

In exchange, Neal Gittleman and Cathie Gittleman have paid:

 

Cash                                                                              $3,100.00 (minimum fee)

 

Plus, Neal Gittleman and Cathie Gittleman will convey to the City:

 

Parcel DY19-039

2,038 square-feet sanitary sewer easement:                 $81,520.00

Valued at $80.00 per square foot x 50%

 

TOTAL CASH AND CONVEYANCE:                          $84,620.00

 

 

Inasmuch as the value of the $3,100.00 minimum fee plus the sanitary sewer easement being conveyed to the City is greater than the value of the water line easement and sanitary sewer easement being abandoned and sold, it is recommended City Council approve an ordinance authorizing the abandonment and sale of a 6 foot-wide water line easement and an 8 foot-wide sanitary sewer easement, in exchange for conveyance to the City of a 15 foot-wide sanitary sewer easement, all within Lot 8, Block 3, out of the Broad Oaks Addition, out of the Charles Sage Survey, A-697.

 

 

 

Fiscal Note:

"Revenue for this item is included in the FY2023 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies."
