SUBJECT: Additional Appropriation to the Construction Contract between the City and Harper Brothers Construction, LLC. for 72-inch Water Line from Emancipation to Tuam along Polk, Hutchins, Clay, Chenevert, Hadley, and Crawford.
RECOMMENDATION: Approve an ordinance appropriating additional funds to the Construction Contract with Harper Brothers Construction, LLC.
PROJECT NOTICE/JUSTIFICATION: This project is part of the City’s long range water supply program and is required to comply with Harris-Galveston Subsidence District and to implement the City’s regionalization plan.
DESCRIPTION/SCOPE: This project consists of approximately 7,850 Linear feet of 72-inch diameter water transmission lines including appurtenances, 72-inch x 72-inch, and 72-inch x 60-inch interconnection, small diameter water lines, sanitary sewer, drainage, and pavement improvements. Approximately 10,200 Linear feet of 60-inch water line condition assessment.

PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on November 13, 2019 under Ordinance No. 2019-0890. The scope of services under the Original Contract consisted of approximately 7,850 linear feet of 72-inch diameter water transmission lines including appurtenances, 72-inch x 72-inch, and 72-inch x 60-inch interconnection, small diameter water lines, sanitary sewer, drainage and pavement improvements. Approximately 10,200 Linear feet of 60-inch water line condition assessment. Under this Contract, the Contractor has accomplished 100% of the scope, with some restoration and final testing to be completed.
SCOPE AND ADDITIONAL APPROPRIATION COSTS: Under the scope of the additional appropriation, the Contractor will replace the existing standard overhead street name signs with illuminated street signs per Midtown Standards.
The total cost of this additional appropriation is $18,557.77 to be appropriated as follows: $18,557.77 for contract services.
HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s ‘Hire Houston First’ (HHF) ordinance that promotes economic opportunity for Houston business and supports job creation. In this case, Harper Brothers Construction, LLC. is a designated HHF company, but they were the successful awardee without application of the HHF preference.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 19%. The original Contract amount totals $48,794,750.39. The Contractor has been paid $45,177,029.00 (92.59%) to date. Of this amount, $9,212,993.46 (20.39%) has been paid to M/WBE Sub-Contractors to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $48,813,308.16. The Contractor is proposing additional funds to Sub-Contractor to meet the MWBE goal.
