Summary:

ORDINANCE consenting to the addition of 1.7586 acres of land to MALCOMSON ROAD UTILITY DISTRICT, for inclusion in the district

Background:

SUBJECT: Petition for the City’s consent to the addition of two (2) tracts of land totaling 1.7586 acres to Malcomson Road Utility District.

  

RECOMMENDATION: Petition for the City’s consent to the addition of two (2) tracts of land totaling 1.7586 acres to Malcomson Road Utility District be approved.

  

SPECIFIC EXPLANATION: Malcomson Road Utility District (the “District”) was created through an act of the Texas Legislature in 1971, and currently consists of 920.2283 acres within Harris County.  The District is within the extraterritorial jurisdiction of the City of Houston (the “City”) and has petitioned the City for consent to add two (2) tracts of vacant land totaling 1.7586 acres, proposed to be developed as commercial property, to the District.  The proposed annexation tracts are located in the vicinity of Louetta Road, North Eldridge Parkway, Spring Cypress Road, and Jones Road.  The addition of land to the District does not release it from the City’s extraterritorial jurisdiction.

 

The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.

 

The District has a wastewater collection system and treatment facility.  The annexation tracts will be provided with wastewater treatment by the Faulkey Gully Wastewater Treatment Facility and Lake Forest Regional Wastewater Treatment Facility. The Lake Forest Regional Wastewater Treatment Facility also provides wastewater treatment to Lake Forest Plant Advisory Council, Harris County Municipal Utility District No. 18, and Cypress Creek Utility District.  Potable water is provided by the District.

 

The nearest major drainage facility for Malcomson Road Utility District is Faulkey Gully, which flows into Cypress Creek, then flows into Spring Creek, then to the San Jacinto River, and finally into Lake Houston. Faulkey Gully is within the Cypress Creek watershed. The proposed annexation tracts are not within the 100 or 500 year floodplain.

 

By executing the Petition for Consent, the District has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the District must be approved by the City prior to their construction. 

  

The Utility District Review Committee recommends that the subject petition be approved.
