Summary:

ORDINANCE appropriating an additional $28,559.21 from Dedicated Drainage and Street Renewal Capital Fund – Drainage Charge for the existing agreement between City of Houston and UNION PACIFIC RAILROAD COMPANY for Kress Street Paving and Drainage Improvements from Larimer Street to Clinton Drive - DISTRICT H - CISNEROS

Background:

SUBJECT: Additional Appropriation to the Public Road At-Grade Crossing Agreement between the City of Houston and Union Pacific Railroad (UPRR) Company for Kress Street Drainage and Paving Improvements from Larimer to Clinton.

 

RECOMMENDATION: Approve an ordinance appropriating additional funds to the Public Road At-Grade Crossing Agreement between the City of Houston and Union Pacific Railroad (UPRR) Company for Kress Street Drainage and Paving Improvements from Larimer to Clinton.

 

PROJECT NOTICE/JUSTIFICATION: The Public Road At-Grade Crossing Agreement is needed to facilitate the construction of Kress Street Project. This project is part of the Storm Drainage Capital Improvement Plan (CIP) program and is required to assist the City with implementation of drainage and paving improvement projects to reduce the risk of structural flooding.

 

DESCRIPTION/SCOPE: Under the scope of the Crossing Agreement, UPRR will remove two existing 40-foot concrete crossing surfaces and asphalt extensions and install two new 56-foot concrete crossing surfaces. UPRR will also relocate existing gates to facilitate correct distances from existing roadway to comply with Manual on Uniform Traffic Control Devices and American Railway Engineering and Maintenance-of-Way Association standards. The City of Houston will reimburse UPRR for one hundred percent 100% of actual costs incurred by UPRR in connection with the Railroad Work.

 

LOCATION: The project is located along Kress Street between Larimer Street and Clinton Drive.

 

PREVIOUS HISTORY AND SCOPE: City Council approved the original Public Road At-Grade Crossing Agreement on September 26, 2018, under Ordinance No. 2018-0759. The scope of services under the original Agreement consisted of improvement of the existing At-Grade Crossing Area along, over and across Railroad’s track and right of way, as a result of construction of Kress Street Project.

 

SCOPE OF THIS ADDITIONAL APPROPRIATION AND FEE: Under the scope of this additional appropriation, the City will fulfill its obligation to reimburse UPRR for one hundred 100% of actual cost incurred for work performed in accordance with the Public Road At-Grade Crossing Agreement. To date, the City has been invoiced a total amount of $228,569.10 under this Agreement.  Council previously appropriated $224,109.00 however only $203,735.00 was available for contract services.  

 

The new requested appropriation is $28,559.21 to be appropriated as follows: $24,834.10 for contract services and $3,725.11 for Contingency.

 

FISCAL NOTE: No significant Fiscal Operating impact is anticipated as a result of this project.
