SUBJECT: First Amendment to the Professional Engineering Services Contract between the City and CP&Y, Inc., for Fondren Road Paving and Drainage from Braeswood Boulevard to Creekbend Drive.
RECOMMENDATION: Approve the First Amendment to the Professional Engineering Services Contract with CP&Y, Inc., and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the Street and Traffic Capital Improvement Plan (CIP) and is necessary to meet City of Houston Standards as well as improve traffic circulation, mobility, and drainage in the service area. Deterioration of existing pavement and drainage and future traffic volume requires that the roadway be reconstructed.
DESCRIPTION/SCOPE: This project consists of the design of approximately 4,000 linear feet of six-lane divided concrete roadway with storm drainage, curbs, sidewalks, driveways, street lighting, traffic control, and necessary underground utilities.
LOCATION: The project area is generally bound by Braeswood Blvd. on the north, Creekbend on the south, Larkwood Drive on the east and Braesridge on the west.
PREVIOUS HISTORY AND SCOPE: City Council approved the original contract on April 08, 2015 under Ordinance No. 2015-0298. The scope of services under the original contract consisted of Phase I- Preliminary Design, Phase II - Final Design, Phase Ill -Construction Phase Services and Additional Services. Under this contract, the Consultant has accomplished 90% completion of the original design.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the First Amendment, the Consultant will accomplish the following: complete the redesign of Fondren Road from Braeswood to Creekbend to incorporate Traffic Drainage and Operations, Brays Oaks Management District Zero and community needs. A fee of $429,894.40 is budgeted for Basic Services and $284,352.80 for Additional Services.
The total requested appropriation is $749,960.20 to be appropriated as follows: $714,247.20 for contract services and $35,713.00 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Consultant provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24%. The original contract amount total $925,000.00. The Consultant has been paid $828,983.29 (89.62%). Of this amount, $376,157.00 (45.38%) has been paid to M/WBE sub-contractors to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $1,639,247.20. The Consultant proposes the following plan to meet the M/WBE goal.
