Summary:

RECOMMENDATION from Director Houston Public Works for approval of final contract amount of $5,463,810.18 and acceptance of work on contract with ANGEL BROTHERS ENTERPRISES, LTD. for FY2019 Pavement Repair & Rehab Work Orders #2 - 8.94% under the original Contract Amount DISTRICTS A - PECK; C - KAMIN; D - EVANS-SHABAZZ; H - CISNEROS and J - POLLARD

Background:

SUBJECT:  Accept Work for FY2019 Pavement Repair & Rehab Work Orders #2.

 

RECOMMENDATION: (SUMMARY) Pass a motion to approve the final Contract Amount of $5,463,810.18 or 8.94% under the Contract Amount, accept the Work and authorize final payment.

 

PROJECT NOTICE/JUSTIFICATION:  This project was part of the City-Wide Overlay Program and was required to improve and maintain a safe road surface and accessibility.

 

DESCRIPTION/SCOPE: This project consisted of the resurfacing of arterial and major thoroughfare streets with asphalt overlay, along with the repair and improvements to curbs and accessible ramps.  The project involved the construction of hot mix asphaltic concrete, base repair, and pavement markings as needed.   The project was designed in-house with 730 calendar days allowed for construction. The project was awarded to Angel Brothers Enterprises, Ltd. with an original Contract Amount of $6,000,000.00.

 

LOCATION: The project was located in seven (7) locations. 

 

CONTRACT COMPLETION AND COST: The Contractor, Angel Brothers Enterprises, Ltd., has completed the work under the subject Contract. The project was completed within the established completion date. The final cost of the project, including overrun and underrun of estimated unit price quantities and previously approved Change Order Nos. 1 and 2 is $5,463,810.18, a decrease of $536,189.82 or 8.94% under the original Contract Amount. The decreased cost is a result of the difference between planned and measured quantities.

 

M/WSBE PARTICIPATION: The advertised goals for this project were 11.00% MBE and 7.00% WBE (18.00% total). The awarded goals for this project were 11.00% MBE, 4.00% WBE and 3.00% SBE (18.00% total). According to the Office of Business Opportunity, the actual participation achieved on this project was 12.04% MBE, 3.85% WBE, and 1.96% SBE (17.85% total). The standard for meeting M/W/SBE participation goals is the demonstration of Good Faith Efforts. The Prime's M/W/SBE performance on this project was rated Satisfactory for the following reasons: The Prime exceeded their MBE contract goal and came within 1.00% of the WBE and SBE contract goals. The Prime leveraged the deviation process to increase their goal attainment and made good faith efforts to utilize approved goal credit subcontractors. For the reasons listed, Angel Brothers Enterprises, Ltd. performance achieved our expectations and meets the intent and the spirit of the City’s M/W/SBE program.
