SUBJECT: Second Amended and Restated Interlocal Agreement for Roadway Improvements, 2007 Mobility Bond Project Nos. 701, 758, and 766 between the City of Houston (City) and Fort Bend County (County).
RECOMMENDATION: (SUMMARY) Approve and authorize the Second Amended and Restated Interlocal Agreement for Roadway Improvements, 2007 Mobility Bond Project Nos. 701, 758, and 766 between the City of Houston (City) and Fort Bend County (County).
PROJECT NOTICE/JUSTIFICATION: This agreement is authorized under the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code. The original agreement is superseded in its entirety and replaced with the Second Amended and Restated Interlocal Agreement (Agreement).
DESCRIPTION/SCOPE: The Agreement provides for a partnership between the City and County to design and construct identified roadway projects. Under the Agreement, the South Post Oak Boulevard project has been constructed. The remaining project consists of design right of way acquisition and construction of Hillcroft Avenue between the existing toll road ramps and an extension of Court Road from Quailynn Road east to the proposed Hillcroft Avenue. This Project will also include the extension of water lines and storm drain systems along each roadway corridor as well as bridges spanning the Fort Bend County Drainage District Ditch B-8-B, box culvert drainage structures crossing Fort Bend County Drainage District Ditch A, and storm water detention.
HPW has published the advertisement for bid on the Hillcroft Avenue and Court Road Extension project and anticipates recommending award to the lowest responsible bidder within the next three month
LOCATIONS:
1. South Post Oak from Sam Houston Tollway to McHard Road
2. Hillcroft Avenue and Court Road Extension from Sam Houston Tollway to McHard Road
PREVIOUS HISTORY AND SCOPE: On June 10, 2009, City Council approved the original agreement under Ordinance No. 2009-0512. The scope of services under the original contract consisted of the design and construction of Fondren Road from Hillcroft to FM 2234 (Fondren); South Post Oak from Beltway 8 to FM 2234 (South Post Oak) and Blue Ridge Road from south of Rockergate Drive to FM 2234 (Blue Ridge Road). The first amendment approved by City Council on June 4, 2014, under Ordinance No. 2014-0558 removed Fondren and Blue Ridge Road from the project and added Hillcroft Avenue and Court Road Extension.
SCOPE OF THIS AMENDMENT: Under the Agreement, the County will contribute a maximum of $5,750.000.00 and the City will contribute $11,750,000.00 towards the increased total cost of the project of $17,500,000.00. The City will be managing the Engineering and Construction Contracts along with managing the acquisition of right of way. The City share of project cost will be appropriated as vendor contracts are presented to Council for approval.
Under the Agreement, the City will also be responsible for the maintenance of Hillcroft as follows:
· mowing grass
· street sweeping
· pavement maintenance
· storm sewer maintenance
· box culvert maintenance
· bridge maintenance
· concrete channel lining maintenance
· sidewalk maintenance
· curb drain maintenance
FISCAL NOTE: No significant Fiscal Operating Impact is anticipated as a result of this project.
