SUBJECT: First Amendment to the Homeowner Agreement for Flood Mitigation Assistance Home Elevation Project for the property owner at 5031 Braesheather Drive, Houston, Texas 77096.
RECOMMENDATION: (SUMMARY) Adopt an ordinance approving and authorizing a First Amendment to Homeowner Agreement for Flood Mitigation Assistance Home Elevation Project between the City of Houston and the property owner at 5031 Braesheather Drive, Houston, Texas 77096 to reflect changes in the contractor’s cost of performance for the 2016 Flood Mitigation Assistance Home Elevation Project, to incorporate an amended Homeowner/Contractor Agreement for the 2016 Flood Mitigation Assistance Home Elevation Project, to incorporate an amended “Final Mitigation Offer,” and to disperse funds associated with the project.
PROJECT NOTICE/JUSTIFICATION: The Flood Mitigation Assistance Grant for 40 flood-prone homes was awarded to the City of Houston on the behalf of the homeowners. On February 14, 2018, City Council passed Ordinance No. 2018-0103 approving an agreement between the City of Houston and Texas Water Development Board for administering the Grant and to receive funds as sub-applicant from the Texas Water Development Board for reimbursement of the cost to complete the elevation of the flood-prone homes up to $12,364,111.50 for 40 approved homes.
City Council adopted Ordinance No. 2019-0747 on October 2, 2019 approving a Homeowner Agreement for Flood Mitigation Assistance Home Elevation Project between the City of Houston and the property owner at 5031 Braesheather Drive., Houston, Texas 77096.
The increase costs that require this first amendment are a result of the power utility company requiring relocation of an electrical delivery power pole.
PROJECT COSTS: The cost increase to the agreement for these services billed by the utility provider to the elevation contractor are $4,413.00. Per the terms of the Agreement, the grant will be responsible for 100% of the cost.
ACTION RECOMMENDED: Adopt an ordinance approving and authorizing a First Amendment to the Homeowner Agreement for Flood Mitigation Assistance Home Elevation Project between the City of Houston and the property owner at 5031 Braesheather Drive, Houston, Texas 77096 to change contractor’s cost of performance for the 2016 Flood Mitigation Assistance Home Elevation Project, to incorporate an amended Homeowner/Contractor Agreement for the 2016 Flood Mitigation Assistance Home Elevation Project, and to incorporate an amended “Final Mitigation Offer.”
