SUBJECT: Accept Work for Keegans Bayou Wastewater Treatment Plant Improvements
RECOMMENDATION: (SUMMARY) Pass a motion to approve the final Contract Amount of $17,458,937.62 or 4.99% over the original Contract Amount, accept the Work and authorize final payment.
PROJECT NOTICE/JUSTIFICATION: This project was part of the City's program to renew/replace inefficient components of the existing Wastewater Treatment Plant facilities.
DESCRIPTION/SCOPE: This project consisted of various improvements at Keegans Bayou Wastewater Treatment Plant including clarifiers, non potable water system, lift station and sludge thickener basins. Atkins North America, Inc. designed the project with 780 calendar days allowed for construction. The project was awarded to Industrial TX Corp. with an original Contract Amount of $16,629,384.00.
LOCATION: The project area is located at 9401 White Chapel Lane.
CONTRACT COMPLETION AND COST: The Contractor, Industrial TX Corp., has completed the work under the subject Contract. The project was completed beyond the established completion date with an additional 493 days approved by Change Order Nos 3 – 9. The final cost of the project, including overrun and underrun of estimated unit price quantities and previously approved Change Order Nos 1, 2, 4 – 7, 9 - 12 is $17,458,937.62, an increase of $829,553.62 or 4.99% over the original Contract Amount and under the 5% contingency amount. The increased cost is a result of the difference between planned and measured quantities.
M/WSBE PARTICIPATION: The advertised M/WBE contract goals for this project were 11% MBE and 7% WBE (18% total). The M/W/SBE goals approved for this project were 11.12% MBE, 3.28% WBE, and 8.95% SBE (23.35% total). According to the Office of Business Opportunity, the actual participation achieved on this project was 9.87% MBE, 3.35% WBE, and 27.67% SBE (40.89% total). The standard for meeting MWSBE participation goals is the demonstration of Good Faith Efforts. The Contractor’s M/W/SBE performance on this project was rated Outstanding for the following reasons: The Prime was successful in exceeding both the WBE and SBE goals on this project. Although, the Prime experienced a minor shortfall in MBE participation due to minimal availability for sludge removal work on this project, the Prime was able to surpass the overall goal for the project by 17.57%. For the reasons listed, the Contractor’s performance exceeded our expectations and meets the intent and the spirit of the City’s MWSBE program.
