Background:

Sole Source for S64-S29954 – Approve the sole source purchase of clinical laboratory reagents and test kits from Becton Dickinson Diagnostic and Company in the amount not to exceed $362,185.67 for the Houston Health Department.

Specific Explanation:

The Director of the Houston Health Department and the Chief Procurement Officer recommend that City Council approve the sole source purchase of clinical laboratory reagents and test kits from Becton Dickinson Diagnostic and Company in the amount not to exceed $362,185.67 for the Houston Health Department and that authorization be given to make purchases, as needed, for a 36-month period with two one-year options.

This award consists of clinical laboratory reagents and test kits to be used by the department's Bureau of Laboratory Services to perform rapid testing to identify the drug susceptibility of mycobacteria tuberculosis cultures. These core laboratory services are vital to effectively diagnose, treat, and control tuberculosis (TB) in the community. The MGIT 960 system and consumables are the standard of care in TB control programs in Texas and across the United States.  The culture system includes instrumentation, culture mediums, reagents, and supplies needed to ensure accurate and rapid detection of TB in clinical specimensIn addition to decreasing the time required to detect and isolate TB, the liquid culture method also increases the sensitivity of culture for tuberculosis.

Becton Dickinson Diagnostic and Company is the sole source manufacturer, designer, and distributor of the clinical laboratory reagents and test kits. There are no other manufacturers, suppliers, or distributors for these products.

This recommendation is made pursuant to subsection 252.022(a)(7) of the Texas Local Government Code, which provides that “a procurement of items that are available from only one source" is exempt from the competitive requirements for purchases.

MWBE Subcontracting:

Zero percentage goal document approved by the Office of Business Opportunity.

 

Hire Houston First:

This procurement is exempt from the City’s Hire Houston First Ordinance.  Bids/proposals were not solicited because the department is utilizing a sole source supplier for this purchase.

 

Fiscal Note:

  • Funding for this item will be included in the FY2023 budget.  Therefore, no Fiscal Note is required as stated in the Financial Policies. 

  • No Fiscal Note is required on grant items.
