HPW - 20WR336 – Petition Addition (13.74) Fort Bend County Municipal Utility District No. 58

Agenda Item#: 22.

Summary:

ORDINANCE consenting to the addition of 13.74 acres of land to FORT BEND COUNTY MUNICIPAL UTILITY DISTRICT NO. 58, for inclusion in its district

Background:

SUBJECT: Petition for the City’s consent to the addition of 13.74 acres to Fort Bend County Municipal Utility District No. 58.

RECOMMENDATION: Petition for the City’s consent to the addition of 13.74 acres to Fort Bend County Municipal Utility District No. 58 be approved.

SPECIFIC EXPLANATION: Fort Bend County Municipal Utility District No. 58 (the “District”) was created through the TCEQ in 1984, and currently consists of 1,380.1992 acres within Fort Bend County.  The District is within the extraterritorial jurisdiction of the City of Houston (the “City”) and has petitioned the City for consent to add 13.74 acres of vacant land, proposed to be developed as single family residential property, to the District.  The proposed annexation tract is located in the vicinity of Horned Owl Drive, Roesner Road, Gaston Road, and Tina Lane.  The addition of land to the District does not release it from the City’s extraterritorial jurisdiction.

The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.

The District has a wastewater collection system and treatment facility.  The annexation tract will be provided with wastewater treatment by the Fort Bend County Municipal Utility District No. 58 Wastewater Treatment Facility. Potable water is provided by the District.

The nearest major drainage facility for Fort Bend County Municipal Utility District No. 58 is Willow fork, which flows into the Barkers Reservoir, then into the Buffalo Bayou, and finally into the Houston Ship Channel. Willow Fork is within the Barkers Reservoir watershed. The proposed annexation tract is not within the 100 or 500 year floodplain.

By executing the Petition for Consent, the District has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the District must be approved by the City prior to their construction.

The Utility District Review Committee recommends that the subject petition be approved.
