Sole Source for N31122 – Approve the sole source purchase from Skalar, Inc. in the total amount of $78,264.00 for one (1) SP-20003 Biochemical Oxygen Demand (BOD) Analyzer to run BOD analysis on wastewater samples for Houston Public Works.
Specific Explanation:
The Director of Houston Public Works and the Chief Procurement Officer recommend that City Council approve the sole source purchase of one (1) SP-20003 Biochemical Oxygen Demand (BOD) Analyzer from Skalar, Inc. in the total amount of $78,264.00 and that authorization be given to issue a purchase order.
The SP-20003 BOD Analyzer will be used to perform BOD analysis on wastewater samples as required by the Environmental Protection Agency and the Texas Commission on Environmental Quality. The BOD test is an empirical bioassay-type test which measures the dissolved oxygen consumed by microbial life while assimilating and oxidizing matter in a sample. A waste sample is incubated for five (5) days at 20° in the dark. Dissolved oxygen is measured before and after incubation. The reduction in dissolved oxygen during the incubation period yields a measure of BOD. HPW performs these tests daily on hundreds of samples. Skalar’s BOD analyzer has three probes which provides the unique capacity to handle the volume of BOD analysis that the wastewater laboratory processes.
This purchase includes installation and training as well as a full one-year warranty on parts and labor resulting from faulty workmanship in manufacture from the date of receipt of the merchandise. This equipment will be delivered to 10500 Bellaire Blvd., Houston, Texas 77072.
Skalar, Inc. is the sole manufacturer, supplier, and distributor of the SP-20003 Biochemical Oxygen Demand (BOD) Analyzer and has not authorized any third party to provide this product.
This recommendation is made pursuant to subsection 252.022(a)(7) of the Texas Local Government Code, which provides that "a procurement of items that are available from only one source..." is exempt from the competitive requirements for purchases.
M/WBE Participation:
This procurement is exempt from the City’s M/WBE subcontracting as the total project expenditure does not exceed the $100,000.00 City’s threshold.
Hire Houston First:
This procurement is exempt from the City's Hire Houston First ordinance. Bids/proposals were not solicited because the Department is utilizing a sole source contractor for this purchase.
Fiscal Note:
Funding for this item is included in the FY22 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
