SUBJECT: Additional Appropriation to the Professional Engineering Services Contract between the City of Houston (City) and R.G. Miller Engineers, Inc. for FY21 Storm Water Action Team (SWAT) Drainage Rehabilitation Design Work Order Contract 1.
RECOMMENDATION: (SUMMARY) Approve an ordinance appropriating additional funds to the Professional Engineering Services Contract for FY21 Storm Water Action Team (SWAT) Drainage Rehabilitation Design Work Order Contract 1 with R.G. Miller Engineers, Inc.
PROJECT NOTICE/JUSTIFICATION: This project is part of the SWAT program and is required to preserve, repair, rehabilitate or reconstruct the storm water drainage asset to such a condition that it may be effectively used for its designated functional purpose.
DESCRIPTION/SCOPE: This City-wide program provides Professional Engineering Services to resolve localized storm water drainage problems that have been nominated by Transportation and Drainage Operations. The project scope and cost is established by each work order. The work orders are prioritized based on a range of factors from public safety to level-of-service.
LOCATION: The project is located throughout the City.
PREVIOUS HISTORY AND SCOPE: City Council approved the original contract on December 2, 2020, under Ordinance No. 2020-1021. The scope of work under the Original contract consisted of Phase I – Preliminary Design Services and Phase II- Final Design Services, Additional and Basic Service Fees for Phase I is based on cost of time and materials not-to-exceed agreed upon amount.
SCOPE AND ADDITIONAL APPROPRIATION COSTS: This additional appropriation is requested to continue Phase I Preliminary Design Services, Phase II Final Design Services, and Phase III Construction Services as they relate to existing and future storm water maintenance, rehabilitation, and reconstruction projects throughout the City. The total requested appropriation is $1,575,000.00.

PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24%. The Original Contract amount total was $1,000,000.00, the Consultant has been paid $201,478.65 (20.15%) to date. Of this amount, $62,494.00 (31.02%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $2,500,000.00. The Consultant proposes the following plan to meet the M/WBE goal.
