ORDINANCE approving and authorizing the execution of a Compromise, Settlement, Release and Indemnification Agreement between JAMES B. LAZARD and City of Houston to settle a lawsuit - $80,000.00 - Property and Casualty Fund

Recommendation:

Approve an ordinance authorizing settlement and release agreement between the City of Houston and James B. Lazard in Cause No. 2019-50320; James R. Lazard v. City of Houston; in the 55^th Judicial District Court of Harris County, Texas (misnomer).

Specific Explanation:

The automobile accident giving rise to this lawsuit occurred at 2:05 a.m. on November 10, 2018, on I-10 when our employee was traveling westbound in Chambers County, Texas in a City leased vehicle and had an at fault accident and rear ended the vehicle driven by Louisiana resident, James B. Lazard.   HPD later found our employee at fault for the accident.

Mr. Lazard was transported to the emergency room from the scene and subsequently treated for numerous injuries.  The past medicals are $118,578.00, and anticipated future medicals are $94,000.00.

Fiscal Note:

Funding for this item is included in the FY2022 Adopted Budget.  Therefore, no Fiscal Note is required as stated in the Financial Policies.
