SUBJECT: Accept Work for Northwest Wastewater Treatment Plant Improvements
RECOMMENDATION: (SUMMARY) Pass a motion to approve the final Contract Amount of $15,426,628.63 or 1.98% over the original Contract Amount, accept the Work and authorize final payment.
PROJECT NOTICE/JUSTIFICATION: This project was part of the City’s on-going program for improvements to major Wastewater Treatment Plants.
DESCRIPTION/SCOPE: This project consisted of upgrades and improvements to the Northwest Wastewater Treatment Plant, including clarifiers, aeration, electrical and mechanical systems. Atkins North America, Inc. designed the project with 750 calendar days allowed for construction. The project was awarded to LEM Construction Co., Inc. with an original Contract Amount of $15,126,655.00.
LOCATION: The project area is located at 5423 Mangum Road.
CONTRACT COMPLETION AND COST: The Contractor, LEM Construction Co., Inc., has completed the work under the subject Contract. The project was completed beyond the established completion date with an additional 240 days approved by Change Order Nos. 3 and 4. The final cost of the project, including overrun and underrun of estimated unit price quantities and previously approved Change Order Nos 1 to 5, is $15,426,628.63, an increase of $299,973.63 or 1.98% over the original Contract Amount and under the 5% contingency amount. The increased cost is a result of the difference between planned and measured quantities.
M/WSBE PARTICIPATION: The advertised M/WBE contract goals for this project were 11% MBE and 7% WBE (18% total). The M/W/SBE goals approved for this project were 8.27% MBE, 7.09% WBE, and 19.87% SBE (35.23% total). According to the Office of Business Opportunity, the actual participation achieved on this project was 7.40% MBE, 7.48% WBE, and 17.62% SBE (32.50% total). The standard for meeting MWSBE participation goals is the demonstration of Good Faith Efforts. The Contractor's M/W /SBE performance on this project was rated Satisfactory for the following reasons: The prime came within 1% of the MBE goal and exceeded the WBE goal. In addition, the Prime exceeded the overall advertised goal and made good faith efforts to utilize all listed certified firms. For the reasons listed, the Contractor's performance meets the intent and spirit of the City's MWSBE program.
