ORDINANCE authorizing the sale of a ten-foot-wide private sanitary sewer easement (Parcel No. SY20-033), out of City fee owned land, being 0.0435 acres located in the James Wharton Survey, Abstract 871, Harris County, Texas, being out of and a part of Restricted Reserve “G”, Block 4 of the Amending Plat of the Amending Plat of Stablewood, selling the easement to 101 FARISH CIRCLE, LLC, a Texas Limited Liability Company, in consideration of its payment to the City of $94,650.00 and other good and valuable consideration - DISTRICT G - TRAVIS

SUBJECT:  Sale of a 10 foot-wide sanitary sewer easement, located in Restricted Reserve G, Block 4 of the Amending Plat of the Amending Plat of Stablewood Addition, out of the James Wharton Survey, A-871.  Parcel SY20-033  

RECOMMENDATION:  It is recommended City Council approve an ordinance authorizing the Sale of a 10 foot-wide sanitary sewer easement, located in Restricted Reserve G, Block 4 of the Amending Plat of the Amending Plat of Stablewood Addition, out of the James Wharton Survey, A-871, in exchange for a consideration of $94,650.00.  Parcel SY20-033

SPECIFIC EXPLANATION:  Robert Erni, Jones | Carter, 2322 West Grand Parkway North, Suite 150, Katy, Texas, 77449, on behalf of Farish Circle, LLC, (Stuart Beken, Managing Partner), requested the sale of a 10 foot-wide sanitary sewer easement, located in Restricted Reserve G, Block 4 of the Amending Plat of the Amending Plat of Stablewood Addition, out of the James Wharton Survey, A-871.  The applicant will use the easement to provide private sanitary sewer service from the existing 10 inch public sanitary line in Stable Lane/Harness Creek Lane to five new residential lots along Farish Circle.  The Joint Referral Committee reviewed and approved this request.

Farish Circle, LLC, has completed the transaction requirements, has accepted the City's offer, and has rendered payment in full. 

The City will sell to Farish Circle, LLC:

1,893 square feet of sanitary sewer easement                                       $94,650.00

Valued at $100.00 per square foot x 50%

Therefore, it is recommended City Council approve an ordinance authorizing the sale of a 10 foot-wide sanitary sewer easement, located in Restricted Reserve G, Block 4 of the Amending Plat of the Amending Plat of Stablewood Addition, out of the James Wharton Survey, A-871, in exchange for a consideration of $94,650.00.      

FISCAL NOTE: Revenue for this item is included in the FY2022 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
