The Housing and Community Development Department (HCDD) recommends Council approval of an Amended and Restated Agreement between the City of Houston (City) and The Village Learning Center, Inc. to extend the Restrictive Use Period for an additional five years, through August 31, 2026 due to a default under the Agreement, pertaining to use of the building (Facility).
During the original contract period, a section of the building was used for dance classes that were not free of charge and were not serving special needs or low-to moderate-income (LMI) clientele. During the extended Restrictive Use Period, the Facility must be used as a Special Needs Facility. This will allow the organization to successfully fulfill contractual requirements of funding to serve only individuals with developmental disabilities by providing rehabilitation, vocational education/training and physical, occupational and speech therapies, benefiting LMI persons through a limited clientele activity.
The Agreement was effective June 8, 2015 and the five-year Land Use Restriction Agreement (LURA) ended June 8, 2020. A default letter was issued to the Owner on June 7, 2021 for breach of obligations as defined under sections 2.13, 2.18, and 2.19 and Exhibit G in the original Agreement for ineligible use of a portion of the building.
The term of this Agreement shall occur five years from the countersignature date of the City Controller, unless sooner terminated as provided for in the Agreement.
There was no formal Housing and Community Affairs Committee meeting during the month of July; therefore, the Chairs were briefed on this item on July 28, 2021.
