Summary:

Background:

S17-H29325.A1 - Amend Council Motion No. 2020-0050, approved on February 5, 2020 to increase the spending authority from $635,098.53 to $1,142,425.19 for the sole source purchase of tariffed telecommunication services for Houston Information Technology Services.

 

Specific Explanation

The Chief Information Officer and the Chief Procurement Officer recommend that City Council amend Council Motion No. 2020-0050 to increase the spending authority from $635,098.53 to $1,142,425.19 for the sole source purchase of tariffed telecommunication services.  Additionally, it is recommended that authorization be given to issue purchase orders, as necessary to Southwestern Bell Telephone d/b/a AT&T Corporation for Houston Information Technology Services. The requested spending authority is expected to sustain the department through June 30, 2023.

 

Southwestern Bell Telephone Company d/b/a AT&T Corporation is the sole source incumbent who provides the City with the current sole source private network and general exchange tariffed services, and maintains exclusivity based on a combination of having: (a) standing as a Local Exchange Carrier in Houston, Texas; (b) product ownership and naming rights; and (c) legacy permission by the Texas Public Utility Commission.

 

The vendor is the only provider for the legacy analog private lines in certain locations within the Greater Houston Area; no other telephone providers can provide this service in these locations. The additional spending authority of $507,326.66 is being requested to allow the vendor to continue to provide the City with legacy analog private lines that are point-to-point or multipoint circuits dedicated to monitoring remote systems and facilities. 

 

This recommendation is made pursuant to subsection 252.022(a)(7) of the Texas Local Government Code, which provides that "a procurement of items that are available from only one source..." is exempt from the competitive requirements for purchases.

 

M/WBE Participation:

M/WBE Zero Percentage Goal Document approved by the Office of Business Opportunity.

 

Hire Houston First:

This procurement is exempt from the City's Hire Houston First Ordinance. Bids/proposals were not solicited because the department is utilizing a sole source for this purchase.

 

Fiscal Note:

Funding for this item is included in the FY2022 Adopted Budget and no Fiscal Note is required as stated in the Financial Policies.
