Summary:

ORDINANCE approving and authorizing an Operation and Maintenance Agreement between City of Houston, Texas, as Owner, and PRECINCT ONE CERT, as Operator, for approximately 7,211 square feet of real property and approximately 1,368 square feet of improvements located at 803 Crosstimbers Street, Houston, Harris County, Texas, to be operated and maintained as a venue for community meetings and events - 5 Years with 1 five-year option - DISTRICT H - CISNEROS

Background:

RECOMMENDATION: Approve and authorize an Operation and Maintenance Agreement between the City of Houston and Precinct One Community Emergency Response Team (Operator), a Texas nonprofit corporation, to use, operate, and maintain City property for community activities.

 

SPECIFIC EXPLANATION: The General Services Department recommends approval of an Operation and Maintenance Agreement with Precinct One Community Emergency Response Team (CERT) for 7,211 square feet of real property and approximately 1,368 square feet of improvements, located at 803 Crosstimbers, for community meetings and events.

 

The agreement provides for a five-year term at a monthly payment of $627.92, or $7,535.04 per year, with one five-year renewal option on the same terms and conditions, except that the rental payments shall be based on the then estimated current market value of the Property. 

 

The annual payment of $7,535.04 represents the fair market rental value. The City will credit Precinct One CERT operation and maintenance costs up to the annual payment of $7,535.04.

 

As consideration for use of the property, Precinct One CERT shall operate, maintain, and improve the property at its sole cost and expense and is responsible for all utilities. All fixtures, improvements, alterations, and additions to the property remain the property of the City of Houston. The City reserves the right to use the property, without charge, a minimum of ten days a year at mutually agreed times.

 

Fiscal Note:

There is no impact to the fiscal budget or no additional spending authority.  Therefore no Fiscal Note is required as stated in the Financial Policies.
