SUBJECT: First Amendment to Professional Engineering Services Contract between the City and Bowman Engineering & Consulting, Inc. (F/K/A Q Consultants, Inc.) dba Quadrant Consultants Inc. for Kirkwood Paving and Drainage: Briar Forest Drive to Westheimer Road.
RECOMMENDATION: Approve First Amendment to the Professional Engineering Services Contract with Bowman Engineering & Consulting, Inc. (F/K/A Q Consultants, Inc.) dba Quadrant Consultants Inc. and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the Street and Traffic Capital Improvement Plan (CIP) and is required to meet the City of Houston standards as well as improve traffic circulation, mobility, and drainage in the service area. The deterioration of existing pavement and future traffic volume requires that this roadway be reconstructed.
DESCRIPTION/SCOPE: This project consists of the design for reconstruction of approximately 4,000 linear feet, a four-lane divided concrete roadway with storm drainage, curbs, sidewalks, driveways, street lighting, traffic control, and necessary underground utilities. The scope includes improvement of drainage and upgrade of the existing roadway to Major Thoroughfare and Freeway Plan (MTFP) standards.
LOCATION: The project area is generally bound by Briar Forest Drive on the north, Westheimer Road on the south, Wilcrest Drive on the east and Dairy Ashford Road on the west.
PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on July 19, 2017 under Ordinance No. 2017-0510. The scope of services under the Original Contract consisted of Phase I - Preliminary Design, Phase II - Final Design, Phase III - Construction Phase Services and Additional Services. Under this Contract, the Consultant has accomplished Phase I - Preliminary Design.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the First Amendment, the Consultant will accomplish Phase II - Final Design, Phase III - Construction Phase Services and Additional Services to revise the scope and update the design for the newly adopted Kirkwood Subproject 1 cross-section of the project configuration. A fee of $30,240.00 is budgeted for Basic Services and $184,615.20 for Additional Services.
The total requested appropriation is $225,597.96 to be appropriated as follows: $214,855.20 for contract services and $10,742.76 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24.06%. The original Contract amount totals $1,200,000.00. The Consultant has been paid $830,050.00 (69.17%) to date. Of this amount, $156,590.00 (18.87%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $1,414,855.20. The Consultant proposes the following plan to meet the M/WBE goal.
