SUBJECT: Accept Work for 108-inch Waterline along City Easements from Union Pacific Railroad to John Ralston Road.
RECOMMENDATION: (SUMMARY) Pass a motion to approve the final Contract Amount of $27,840,979.24 or 1.69% under the original Contract Amount, accept the Work and authorize final payment.
PROJECT NOTICE/JUSTIFICATION: This project was part of the City’s Surface Water Transmission program and supported the execution of the Northeast Transmission line projects from the Northeast Water Purification Plant to the Water Authorities take-points for the Infrastructure Capital Improvement Plan. It was required to improve existing water distribution systems and to meet Harris-Galveston Coastal Subsidence District’s Legislative mandate to regulate the withdrawal of groundwater. The project was a combination of water line construction, public utility adjustments and roadway pavement replacement.
DESCRIPTION/SCOPE: This project consisted of the construction of approximately 7,800 linear feet of a 108-inch and 130 linear feet of a 24-inch transmission water line, and along with associated adjustments to storm sewer, and roadway pavement. Aurora Technical Services, LLC and Lockwood, Andrews & Newnam designed the project with 570 calendar days allowed for construction. The project was awarded to Harper Brothers Construction, LLC with an original Contract Amount of $28,318,720.05.
LOCATION: The project area is along North Sam Houston Parkway East and City easements from East of Union Pacific Railroad to John Ralston Road.
CONTRACT COMPLETION AND COST: The Contractor, Harper Brothers Construction, LLC., has completed the work under the subject Contract. The project was completed beyond the established completion date with an additional 15 days approved by Change Order Nos. 2, 4, 5, and 6. The final cost of the project, including overrun and underrun of estimated unit price quantities and previously approved Change Order Nos. 2, 3 and 5 is $27,840,979.24, a decrease of $477,740.81 or 1.69% under the original Contract Amount. The decreased cost is a result of the difference between planned and measured quantities.
M/WSBE PARTICIPATION: The advertised M/WSBE contract goals for this project were 12.00% MBE and 7.00% WBE (19.00% total). The M/W/SBE goals approved for this project were 10.75% MBE, 5.11% WBE, and 3.16% SBE (19.02% total). According to the Office of Business Opportunity, the actual participation achieved on this project was 8.91% MBE, 5.61% WBE, and 1.43% SBE (15.95% total). The standard for meeting MWSBE participation goals is the demonstration of Good Faith Efforts. The Contractor’s M/W/SBE performance on this project was rated Satisfactory Due to Good Faith Efforts for the following reasons: The Prime exceeded the WBE goal on the contract. Although the Prime failed to meet the MBE and SBE goal, they made good faith efforts to utilize all listed MWSBE goal credit subcontractors to full capacity. For the reasons listed, the contractor's performance meets the intent and the spirit of the City of Houston's MWBE program.
