SUBJECT: Agreement to Contribute Right of Way Funds (Fixed Price) between the City of Houston (City) and Texas Department of Transportation (TxDOT) for FM 1960 from Mills Road to SH 249.
RECOMMENDATION: Adopt an ordinance approving and authorizing an Agreement to Contribute Right of Way Funds (Fixed Price) between the City of Houston (City) and Texas Department of Transportation (TxDOT) for FM 1960 from Mills Road to SH 249 and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: Texas Transportation Code 201.209 authorizes the State and Local Government to enter into agreements. TxDOT has deemed it necessary to make certain highway improvements on FM 1960 from Mills Road to SH 249. This section of the highway improvements will necessitate the acquisition of certain Right of Way (ROW) and relocating and adjusting utilities.
DESCRIPTION: This project consists of ROW acquisition and utility adjustments for future improvements to FM 1960 which will include a shared use path (bicycle infrastructure improvements) and a sidewalk project.
LOCATION: The project is located at Mills Road on the south side of FM 1960 going east, and then south at SH 249 South Bound Feeder Road (SBFR) about 650 ft to the bus stop. The sidewalk will start at Mills Road on the north side of FM 1960 going east and stops at SH 249 SBFR.
SCOPE OF THE AGREEMENT AND FEE: TxDOT has submitted a total cost estimate for the acquisition of the right of way and utility adjustments in the amount of $7,115,000.00. The City will be responsible for 10% of the estimated acquisition and utility adjustment costs in the amount $711,500.00. In addition, $71,150.00 is needed for contingencies and $35,575.00 is needed for CIP Cost Recovery for a total appropriation of $818,225.00.
FISCAL NOTE: No significant Fiscal Operating Impact is anticipated as a result of this project.
