SUBJECT: Accept work for FY2019 Drainage Rehab Work Orders #4.
RECOMMENDATION: (SUMMARY) Pass a motion to approve the Final Contract Amount of $5,982,088.89 or 0.30% under the revised Contract Amount, accept the Work and authorize final payment.
PROJECT NOTICE/JUSTIFICATION: This project was part of the City of Houston (City) Local Drainage Project and was required to meet local storm water drainage system improvements and repairs citywide.
PREVIOUS HISTORY: The original contract was approved on December 5, 2018 by Ordinance 2018-0978. This project consisted of local storm water drainage system improvements citywide. It also addressed certain large–scale storm water drainage system repairs. The project was awarded to PM Construction & Rehab, LLC, with an Original Contract Amount of $3,000,000.00 and an additional appropriation of $ 3,000,000.00, for a revised total contract amount of $6,000,000.00. The contract duration for this project was 730 calendar days.
LOCATION: The projects were at 22 various locations in Council Districts A, B, C, D, G, H, J and K.
CONTRACT COMPLETION AND COST: The Contractor, PM Construction & Rehab, LLC, has completed the work under the subject Contract. The project was completed on time. The final cost of the project, including overrun and underrun of estimated unit price quantities is $5,982,088.89 a decrease of $17,911.11 or 0.30% under the total contract amount.
The increased cost is a result of the difference between planned and measured quantities.
M/WSBE PARTICIPATION: The advertised M/WBE contract goals for this project were 11% MBE and 7% WBE (18% total). The M/WBE goals approved for this project were 7% MBE, 7% WBE and 4% SBE (18% total). According to the Office of Business Opportunity, the actual participation achieved on this project was 49.59% MBE, 1.93% WB and SBE 3.22% (54.75% total). The standard for meeting MWBE participation goals is the demonstration of Good Faith Efforts. The Contractors M/W/SBE performance on this project was rated Satisfactory for the following reasons: The Prime exceeded the MBE goal and came within two percent (2%) of the WBE goal. While the Prime fell short of the WBE goal due to the scope of the work orders issued on this customer complaint driven contract, the Prime made good faith efforts to meet the goal. For the reasons listed, the Contractor’s performance meets the intent and the spirit of the City’s MWSBE program.
