SUBJECT: Second Amendment to a Water Supply Contract between the City of Houston and the City of Humble
RECOMMENDATION: (Summary) Approve an ordinance authorizing the Mayor to execute a Second Amendment to a Water Supply Contract between the City of Houston and the City of Humble.
SPECIFIC EXPLANATION: The City of Houston (“Houston”), City Council, approved a Treated Water Supply Contract (the Original Contract) on September 17, 1997, Ordinance 97-1136 with the City of Humble (“Humble”) so that Houston could sell treated water to Humble. Under the Original Contract, Humble purchased water from Houston from a point on the west side of Humble and then re-sold water to Houston on the east side of Humble. Without this arrangement in the Original Contract, Houston would find it difficult and expensive to serve its customers on the east side of Humble.
On September 11, 2002, Houston City Council approved the First Amendment to the Original Contract by Ordinance 2002-0846 to provide Humble with additional water to comply with the Harris-Galveston Coastal Subsidence District regulations.
Currently, Houston provides water service to one customer on the east side of Humble, within Humble’s city limits. This Second Amendment allows Humble to relocate an existing meter on the east side of Humble to allow them to provide service to new customers within their city limits. Upon payment of $43,680 by Humble for the segment of water line, Houston will transfer the meter, water line segment, and existing customer to Humble. Humble will own and maintain all of the water line within Humble’s city limits and provide service to all customers within its jurisdiction.
Approval of the Second Amendment is requested.
