SUBJECT: Adopt an Ordinance approving payment of certain contract funds to Resicom, Inc. for Safe Sidewalk Project; WBS No. N-00610A-0119-4.
RECOMMENDATION: (Summary) Adopt an Ordinance approving payment of certain contract funds in the amount of $21,765.53 to Resicom, Inc. for Safe Sidewalk Project; WBS No. N-00610A-0119-4.
PROJECT NOTICE/JUSTIFICATION: This project was part of the continuing effort by the City to construct sidewalks throughout the City of Houston to meet the needs of its resident.
DESCRIPTION/SCOPE: This project provided for the construction of sidewalk improvements at numerous locations. Zarinkelk Engineering Services designed the project with 188 calendar days allowed for construction. The project was awarded to Resicom, Inc. with an original Contract Amount of $904,159.20.
LOCATION: The project is located in various Key Map Grids.
CONTRACT COMPLETION AND COST: The Contractor last performed work under the Contract on 06/15/2012, a date 26 days beyond the established completion date for the project, and no further work by Contractor is contemplated. Money remains encumbered under the Contract. This recommended action will authorize PWE to administratively close this Contract and to pay the net amount $21,765.53 after the deduction of the liquidated damages (26 days at $800.00/day = $20,800.00) and other adjustments as determined by the City Engineer.
The City notified Contractor of the City’s intention to close the project by letter date 08/26/2014.
Council’s approval will allow PWE to make all payments due to the Contractor, without any further action or stipulation by the Contractor, and nothing in the ordinance shall be deemed to be an acceptance of Contractor’s work or a waiver of any claims the City may have under Contract.
MBE/SBE PARTICIPATION: The Contract was not a goal-oriented Contract per Art. V, Chapter 15.
