It is recommended City Council approve a Motion authorizing the abandonment and sale of Rosalie Street, from Brazos Street to Smith Street, located in the Fairgrounds Addition, out of the Obedience Smith Survey. Parcels SY14-138, SY15-035, and SY15-036
Andrew D. Garza, Terra Associates, 21445 North Loop West, Suite 450, Houston, Texas, 77008, on behalf of Morgan Group Brazos/Rosalie, LLC, (Philip Morgan, Vice President), requested the abandonment and sale of Rosalie Street, from Brazos Street to Smith Street, located in the Fairgrounds Addition, out of the Obedience Smith Survey. The applicant plans to construct a mid-rise multi-family development.
This is Part One of a two-step process in which the applicant will first receive a City Council authorized Motion acknowledging the concept of the subject request. Upon the applicant satisfactorily completing all transaction requirements including those enumerated below, the Department of Public Works and Engineering will forward a subsequent recommendation to City Council requesting passage of an Ordinance effecting the sale. The Joint Referral Committee reviewed and approved this request. Therefore, it is recommended:
1. The City abandon and sell Rosalie Street, from Brazos Street to Smith Street, located in the Fairgrounds Addition, out of the Obedience Smith Survey;
2. The applicants be required to furnish the Department of Public Works and Engineering with a durable, reproducible (Mylar) survey plat and field notes of the affected property;
3. The applicants be required to: (a) eliminate the public street appearance of Rosalie Street by removing the existing pavement and extending the curb and sidewalk across Smith Street and Brazos Street; (b) remove all traffic signs in the right-of-way abandonment area and return the signs and poles to the City at 2200 Patterson Street; (c) contact CenterPoint Energy Street Lighting Design Section to deactivate and remove the lights and poles in the abandonment area; and (d) complete the forgoing items at no cost to the City and under the proper permits obtained separately and exclusively from the Office of the City Engineer;
4. The applicants be required to: (a) cut, plug, and abandon the 6-inch and 8-inch water lines in Rosalie Street, from the 8-inch water line in Brazos Street to the 24-inch water line in Smith Street; (b) relocate any service connections to the 8-inch water line in Brazos Street or the 24-inch water line in Smith Street; (c) cut, plug, and abandon the 8-inch sanitary sewer line in Rosalie Street, from manhole #II175039 in Brazos Street east to manhole #II175038 in Smith Street; (d) install a new manhole on the 12-inch sanitary sewer line in Brazos Street connecting the remaining portion of the 8-inch sanitary sewer line west of the abandonment area to the 12-inch sanitary sewer line; (e) relocate any service connections to the 12-inch sanitary sewer line in Brazos Street or the 12-inch sanitary sewer line in Elgin Street.; (f) relocate the fire hydrant in Rosalie Street to Smith Street; (g) relocate the 15-inch storm sewer line, its inlets, and the manhole located near the intersection of Rosalie Street and Brazos Street to Brazos Street; (h) relocate the 24-inch storm sewer line and its inlets located near the intersection of Rosalie Street and Smith Street to Smith Street; (i) the foregoing items must be completed as stated unless conditions on the ground or city standards require modifications to items (a) through (h); (j)pay the depreciated value of the water lines, sanitary sewer line, storm sewer inlets, storm sewer lines, and manhole; (k) complete the forgoing items at no cost to the City and under the proper permits obtained separately and exclusively from the Office of the City Engineer; and (l) provide a Certificate of Final Completion issued by the Office of the City Engineer;
5. The applicants be required to prepare drawings that show all public utilities (water, sanitary, and storm sewer) that are to be abandoned, privatized, relocated, and/or constructed as part of this project and submit a drawing to the Office of the City Engineer for plan review and approval. A copy of the Motion shall be attached to the plan set when it is submitted for plan review;
6. The applicants be required to provide letters of no objection from each of the privately owned utility companies for the street being abandoned;
7. The applicants be required to provide a letter from the Midtown Redevelopment Authority/TIRZ #2 acknowledging the proposed project.
8. The Legal Department be authorized to prepare the necessary transaction documents; and
9. Inasmuch as the value of the City’s property interests are expected to exceed $1,000,000.00, that City Council appoint Scott Stephens and Sheila Stewart, independent real estate appraisers, to establish the value.
