SUBJECT: First Amendment to Professional Engineering Services Contract between the City and TLC Engineering, Inc. for Chimney Rock Connectivity to Fort Bend Tollway (Abide and Altair).
RECOMMENDATION: Approve First Amendment to the Professional Engineering Services Contract with TLC Engineering, Inc. and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the Street and Traffic Capital Improvement Plan (CIP) and is necessary to extend Chimney Rock to serve as feeder/frontage roads along both sides of Fort Bend Toll Road. This program is required to extend this roadway to provide the missing area of pavement and access to the surrounding areas.
DESCRIPTION/SCOPE: This project consists of the design of approximately 2,400 linear feet of two-lane roadway with associated drainage and utility modifications. Additionally, two local streets will be extended (Altair and Abide) to provide additional outlets for the neighboring community.
LOCATION: The project area is generally bound by Main Street on the north, W. Orem Drive on the south, S. Post Oak Road on the east, and Summit Ridge Drive on the west.
PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on November 29, 2017 under Ordinance No. 2017-0908. Under this Contract, the Consultant has completed the Preliminary Engineering Report. On April 17, 2019 by Ordinance No. 2019-0273, City Council approved an Additional Appropriation. Under this Additional Appropriation, the Consultant has accomplished tasks Phase I – Preliminary Design and Phase II Final Design.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the First Amendment, the Consultant will accomplish the following: Design and inspection of the additional sidewalks and modifications to the existing intersection at Chimney Rock and W. Orem Drive. A fee of $101,453.00 is budgeted for Basic Services and $22,880.00 for Additional Services.
The total requested appropriation is $130,549.65 to be appropriated as follows: $124,333.00 for contract services and $6,216.65 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor has elected to pay into the Contractor Responsibility Fund in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24%. The original Contract amount and subsequent appropriation total $383,661.65. The Consultant has been paid $313,686.47 (81.76%) to date. Of this amount, $58,287.00 (18.58%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $507,994.65. The Consultant proposes the following plan to meet the M/WBE goal.
