ORDINANCE approving and authorizing two Landscape Architecture Task Order Contracts between City of Houston and CLARK CONDON ASSOCIATES, INC, and M2L ASSOCIATES INC for Design Services for the Landscape Architecture Task Order Contracting Program; setting a maximum contract amount - 3 Years with two one-year options

Background:

RECOMMENDATION: Approve two landscape architecture task order contracts for design services with Clark Condon Associates, Inc. and M2L Associates Inc. for the Landscape Architecture Task Order Contracting Program.

SPECIFIC EXPLANATION: The General Services Department (GSD) recommends that City Council approve two landscape architecture task order contracts with Clark Condon Associates, Inc. and M2L Associates Inc., to perform design and construction administration services for the Houston Parks and Recreation Department (HPARD) capital improvement projects, and delegate authority to the director to approve supplemental allocations up to the maximum contract amount for each contract of $3,000,000.00. Each contract provides for a term of three years with two one-year renewal options.

On December 20 and 27, 2019, GSD advertised a Request for Qualifications (RFQ) for landscape architectural consulting services referencing federally funded Community Development Block Grant (CDBG) requirements relating to the use of CDBG funds for design and engineering services for various parks and National Office of Ocean and Atmospheric Administration (NOAA) requirements for funds used on Sylvan Rodriguez Park. The RFQ contained selection criteria that ranked the respondents on recent project experience, recent task order contracting experience, and proposed personnel’s experience. The Statements of Qualifications were due on January 23, 2020, and five firms responded. A selection committee comprised of GSD and HPARD representatives evaluated and ranked the respondents. Two firms were qualified based on the advertised criteria.

Sylvan Rodriguez Park is the only project for which funds will be allocated at the award of these contracts. Funds for other projects, including federally funded Community Development Block Grant (CDBG) funded projects, will be allocated with future Council action.

PROJECT LOCATION: Sylvan Rodriguez Park – 1201 Clear Lake City Blvd. – Dist. E

SCOPE OF CONTRACT AND FEES: Under the terms of the contracts, the consultants will provide professional design services on an as-needed basis for the HPARD capital improvement projects. These services include drawings and specifications, construction/repair cost estimating, and construction administration. Basic services fees for each task order will be negotiated based upon the size and complexity of the project and paid on a lump sum basis

 

M/WBE PARTICIPATION: An M/WBE goal of 24% has been established for each contract. For task order contracts, sub-consultant utilization will be determined as projects and proposals are produced. Each consultant has submitted the following certified firms to achieve the goal:

PAY OR PLAY PROGRAM: The proposed contracts require compliance with the City’s “Pay or Play” Ordinance regarding health benefits for employees of City Contractors. In this case, the design consultants provide health benefits to eligible employees in compliance with the City policy.

CIP FISCAL NOTE: Funding for this item is included in the FY2022;  therefore, no Fiscal Note is required as stated in the Financial Policy.
