Summary:

RECOMMENDATION from Director Houston Public Works for approval of final contract amount of $17,091,575.71 and acceptance of work on contract with STERLING DELAWARE HOLDING COMPANY, INC for Greens Road Paving and Drainage Improvements - 0.34% under the original contract amount - DISTRICT B - JACKSON

Background:

SUBJECT: Accept Work for Greens Road Paving and Drainage Improvements.

 

RECOMMENDATION: (SUMMARY) Pass a motion to approve the final Contract Amount of $17,091,575.71 or 0.34% under the original Contract Amount, accept the Work and authorize final payment.

 

PROJECT NOTICE/JUSTIFICATION: This project was part of the Street and Traffic Capital Improvement Project (CIP) and was required to meet City of Houston Standards as well as improve traffic circulation, mobility, and drainage in the service area. The construction of this project involved removal of a two-lane asphalt roadway that was replaced by a four-lane divided concrete boulevard section with curbs and gutter. Federal funding participation was approved by Houston Galveston Area Council under the 2013-2016 Transportation Improvement Program. The Federal government refunded the City 80% of the construction cost, a maximum of $9,481,200.00.

 

DESCRIPTION/SCOPE: On June 6, 2001, City Council approved Ordinance 2001-0503, a Cost Sharing Agreement with TxDOT for preliminary engineering services which provided the federal share at 80% and the local government share at 20%. On May 13, 2009, City Council approved Ordinance 2009-0406 for engineering services in the amount of $219,101.00 which included the federal share at 80% and the local government share at 20%. On July 29, 2015, City Council approved Ordinance 2015-0707 for $40,018.00 for the initial payment due to TxDOT for engineering plan review. 

 

This project consisted of the construction of approximately 7,700 linear feet of roadway to Major Thoroughfare Plan standards. The proposed project included reconstruction of a four-lane divided roadway that consisted of approximately 55,504 square yards of 10-inch reinforced concrete  pavement with curbs and gutters; approximately 7,484 linear feet of 24 to 48-inch diameter storm sewer pipe; and 3,700 linear feet of storm boxes ranging from 4’ x 3’ to 7’ x 5’; and approximately 4,900 linear feet of 24-inch diameter water line with all appurtenances including detention pond and a fire station signal at 3300 Greens Road. The project also included construction of new parallel bridges across Hood’s Bayou and a cross culvert at Old Hood's Bayou with necessary driveways, sidewalk, and street lightings. AECOM Technical Services, Inc. designed the project with 944 calendar days allowed for construction. The project was awarded to Sterling Delaware Holding Company, Inc. with an original Contract Amount of $17,149,149.89.

 

LOCATION: The project area is generally bound by Aldine Westfield on the west and John F Kennedy Boulevard on the east.

 

CONTRACT COMPLETION AND COST: The Contractor, Sterling Delaware Holding Company, Inc. has completed the work under the subject Contract. The project was completed beyond the established completion date with an additional 124 days approved by Change Order Nos. 2 and 22. The final cost of the project, including overrun and underrun of estimated unit price quantities and previously approved Change Order Nos. 1 and 3 - 22 is $17,091,575.71, a decrease of $57,574.18 or 0.34% under the original Contract Amount. The decreased cost is a result of the difference between planned and measured quantities.


M/WSBE PARTICIPATION: The advertised DBE contract goal for this project was 6.00% DBE. The DBE goal approved for this project was 9.14%. According to the Office of Business Opportunity, the actual participation achieved on this project was 4.33% DBE. The standard for meeting DBE participation goal is the demonstration of Good Faith Efforts. The Contractor's DBE performance on this project was rated as Unsatisfactory because they fell short of the contract goal, failed to utilize all listed DBE firms, and failed to make good faith efforts to identify additional DBE-certified firms to meet the goal. For the reasons listed, the Contractor's performance does not meet the intent nor the spirit of the City of Houston's MWSDBE program.
