**PULLED – This item will not be considered on April 21, 2021

ORDINANCE approving and authorizing third amendment to Ordinance No. 2011-709, as amended, to increase spending authority for License Agreement between City of Houston, Texas, Licensee, and AMERICAN TOWERS, INC, Licensor, to fund the second renewal term of the license

Background:

RECOMMENDATION:

Approve and authorize an amending ordinance to Ordinance No. 2009-1102, passed on November 10, 2009, as amended, to establish a maximum contract amount from $619,049.48 to $2,702,624.49 for the Lease Agreement between American Towers (Lessor) and the City of Houston (Lessee), at 819 Battleground Road, Deer Park, Texas, for the continued lease space and the operation and maintenance of the communications tower and equipment for Houston Information Technology Services (HITS).

SPECIFIC EXPLANATION:

The Chief Information Officer (CIO) recommends that City Council approve an amending ordinance to the Lease Agreement between the City of Houston and American Towers increase the maximum contract amount from $ 619,049.48 to $2,702,624.49 for the continued lease space and the operation and maintenance of the communications tower and related equipment enclosure space supporting the Houston’s Public Radio Communications System for HITS.

The original contract was awarded on November 10, 2009 by Ordinance No. 2009-1102, for a ten-year term with two ten-year renewal option terms for the construction and installation of a communications tower and the lease of ground space for communications equipment in connection with the Public Safety Radio System located at 819 Battleground Road, Deer Park, Texas. Ordinance No. 2011-0042, adopted on January 12, 2011, amended the original contract to increase the monthly license fee.

The Radio Communications System requires tower-mounted antennas and equipment throughout the City of Houston to ensure continuous radio communications coverage for HITS, HPD, HFD, HPW, and other City departments and external public user entities. The increase of this maximum contract amount will allow HITS to continue to lease the space and operate and maintain the existing antennas and other communication equipment located at 819 Battleground Road, Deer Park, Texas.

This item was presented to the Transportation, Technology & Infrastructure (TTI) Committee on April 1, 2021.
