| | | | | | | | Background:
The City of Houston (City) and the Houston Independent School District (HISD) are parties to an Ancillary Land Exchange Agreement (Ancillary Agreement) authorized and approved by City Council on June 8, 2005, pursuant to Ordinance No. 2005-702. The Ancillary Agreement extends to HISD credits (HISD Credits) for properties ‘struck-off’ at constable tax-foreclosure sales to the City and subsequently, conveyed to the Land Assemblage Redevelopment Authority (LARA). Under the terms of the First Amendment to the Urban Redevelopment Interlocal Agreement (Interlocal Agreement) also approved by City Council under the aforementioned ordinance on June 8, 2005, the HISD Credits are to be used exclusively for the exchange of parcels of land between the City and HISD.
City Council authorized a First Amendment to the Ancillary Agreement on March 25, 2009, pursuant to Ordinance No. 2009-225, to increase the HISD Credit from $500 to $1,000 for each property ‘struck-off’ and conveyed to LARA. Under this Second Amendment to the Ancillary Agreement, the City agrees to grant HISD a $1,500 HISD Credit for each parcel stuck-off and conveyed to LARA that are subject to the terms of a proposed, Restated Urban Redevelopment Interlocal Agreement between the Land Assemblage Redevelopment Authority, the City of Houston and other local taxing units.
