SUBJECT: Accept work for FY2014 Local Drainage Project Construction Work Orders #2.
RECOMMENDATION: (SUMMARY) Pass a motion to approve the final Contract Amount of $4,504,100.74 or 0.09% over the revised Contract Amount and under the 5% contingency, accept the Work and authorize final payment.
PROJECT NOTICE/JUSTIFICATION: This project was part of the Capital Improvement Plan (CIP) and was required to meet local storm water drainage system improvements and repairs citywide.
DESCRIPTION/SCOPE: This project consisted of local storm water drainage system improvements citywide. It also addressed certain large–scale storm water drainage system repairs. The project was awarded to T. Construction, LLC, with an Original Contract Amount of $3,000,000.00 and an additional appropriation of $1,500,000.00, for a revised total contract amount of $4,500,000.00. The contract duration for this project was 1,095 calendar days.
LOCATION: The projects were located at 47 various locations in Council Districts A, B, C, D, E, F, G, H, I, J and K.
CONTRACT COMPLETION AND COST: The Contractor, T. Construction, LLC, has completed the work under the subject Contract. The project was completed beyond the established completion date with an additional 1,095 days approved by Change Order Nos. 5, 7 and 14. The final cost of the project, including overrun and underrun of estimated unit price quantities and previously approved Change Order Nos, 1, 3, 4, 5 and 6 is $4,504,100.74, an increase of $4,100.74 or 0.09% over the total contract amount and under the 5% contingency.
The increased cost is a result of the difference between planned and measured quantities.
M/WSBE PARTICIPATION: The advertised M/WBE contract goals for this project were 11.00 % MBE and 7.00% WBE (18.00 % total). The M/W/SBE goals approved for this project were 11.00 % MBE, 7.00% WBE and 0% (18.00 % total). According to the Office of Business Opportunity, the actual participation achieved on this project was 13.16% MBE, 6.43% WBE and 0.17% SBE (19.76% total). The standard for meeting MWSBE participation goals is the demonstration of Good Faith Efforts. The Contractor’s M/W/SBE performance on this project was rated Satisfactory for the following reasons: Prime exceeded the awarded MBE goal and made a good faith effort to achieve the awarded WBE goal, coming within 1% of the goal. For the reasons listed, the Contractor’s performance meets the intent and spirit of the City’s MWSBE program.
