Summary:

ORDINANCE approving and authorizing second amendment to TEXAS GENERAL LAND OFFICE (“GLO”) Contract No. 19-076-008-B357, the Community Development Block Grant Disaster Recovery 2016 Flood Events (CDBG-DR16) Subrecipient Agreement between City of Houston and GLO administering the CDBG-DR16 Housing Buyout Program, to extend the contract term of the agreement, add additional reporting requirements and documentation, and add or revise other certain provisions

Background:

The Housing and Community Development Department (HCDD) recommends Council approval of an Ordinance authorizing the Mayor (or Mayor’s designee) to execute a Second Amendment to the Contract between the City of Texas (City) and the Texas General Land Office (GLO), to extend the contract timeline, and update certain contract provisions and reporting requirements relating to Community Development Block Grant Disaster Recovery for the 2016 Flood Events (CDBG-DR16) funds.

 

On February 19, 2019, through Ordinance No. 2019-109, Council authorized the Mayor to execute contract No. 19-076-008-B357 for $23,486,698.00 of CDBG-DR16 funds, to fund a buyout program (Program) for properties located in the floodplain. The Second Amendment to the Contract will update the following:

·       Extension of the contract timeline by one year 

·       Certain contract provisions

·       Reporting requirements and documentation

 

 

The CDBG-DR16 Buyout Program currently has three properties in the buyout pipelineA multifamily property near Fondren Drive has been acquired and has been transferred to Houston Public Works. Another property on Chimney Rock Drive was approved for purchase in November 2020. One additional property is in process for approval. The contract period extension request is needed due to delays related to COVID-19 and relocation accommodations. Contract updates will include items regarding public information access, force majeure, and equal opportunity. Reporting requirements were updated to include a new process for subrecipient contract management.
