Summary:

ORDINANCE approving and authorizing Maintenance and Encroachment Agreement between City of Houston and UNIVERSITY OF HOUSTON for University of Houston Road Improvement Project at Cullen Boulevard and North MacGregor Way to Interstate Highway 45 Frontage Road - DISTRICT D - EVANS-SHABAZZ

Background:

SUBJECT: Maintenance & Encroachment Agreement between the City of Houston and University of Houston for the University of Houston Road Improvement project at Cullen Boulevard from North MacGregor Way to Interstate Highway 45 Frontage Road.

 

 RECOMMENDATION: Adopt an ordinance approving and authorizing a Maintenance & Encroachment Agreement between the City and the University of Houston for University of Houston Road Improvement project.

 

 PROJECT NOTICE/JUSTIFICATIONReconstruct Cullen Boulevard from North MacGregor Way to Interstate Highway 45.  This Agreement between the City and University entails the maintenance of the improvements within the City’s right-of-way for the University of Houston Road Improvement project.

 

 DESCRIPTION: This Agreement establishes the service area to be managed by the University and allows the University to perform all necessary maintenance to the improvements within the service area.  The term of the agreement is 10 years with 2 ten-year renewals. In accordance with the agreement, the University’s obligations include the following improvements: non-standard design elements, including trees, irrigation, landscaping, underground modular stormwater storage tanks and associated pipe, engineered soils, permeable unit pavers, trench drains, colored concrete, bollards, bus stop shelters, special signs that are not required by the roadway design and operation, pedestrian lights and other enhancements to the projectThe Agreement also specifies the specific Standard Elements to be maintained by the City.  The City’s obligations include the maintenance of the following:  bikeway paving and signage, pavement markings/striping, ADA curb ramps and/or speed tables, storm drainage inlets, storm sewer piping, water lines, wastewater lines, traffic signals, and roadway paving.

 

 LOCATION: The project is located at Cullen Boulevard from North MacGregor Way to Interstate Highway 45 Frontage Road, within the City’s right-of way and the University of Houston property.

 

 SCOPE OF THE AGREEMENT AND FEE:  The University desires to retain ownership of the Non-Standard Elements within the City right-of-way. The City is agreeable to the University’s retaining ownership subject to certain terms and conditions. There is no cost to the City for this maintenance agreement.

 

 FISCAL NOTE: No significant Fiscal Operating Impact is anticipated as a result of this project.
