SUBJECT: An Ordinance approving Public Improvement Agreement between the City of Houston, Reinvestment Zone Number Twenty Three, City of Houston, and East End On The Bayou, L.P. - DISTRICTS H - GONZALEZ; I - GALLEGOS
RECOMMENDATION: (Summary)
That City Council approves an ordinance approving a Public Improvement Agreement between the City of Houston, Reinvestment Zone Number Twenty Three, City of Houston, and East End On The Bayou, L.P.
SPECIFIC EXPLANATION:
Reinvestment Zone Number Twenty Three, City of Houston, Texas ("Zone") was created by Ordinance 2011-0900, adopted by City Council on October 19, 2011. City Council (“City”) approved a Project Plan and Reinvestment Zone Financing Plan (“Plan”) for the Zone by Ordinance 2013-0101, on February 6, 2013. The Plans provide for expenditures related to public utility improvements, roadways, street, sidewalks and lighting. By Resolution 2013-0051, approved on October 16, 2013, the City the created the Harrisburg Redevelopment Authority (“Authority”) to help implement the Plan. As a Tri-Party Agreement between the City, the Authority, and the Zone has not been approved by the City, the City must approve Agreements entered into by the Zone.
On November 6, 2014, the Board of Directors of the Zone approved a Public Improvement Agreement (“Agreement”) between the City, the Zone and East End On The Bayou, L.P. The Agreement provides for the reimbursement of costs to be paid by the developer related to the design and construction of public infrastructure improvements. These improvements include sewer, water and street construction are estimated to cost $1,238,068. The contract provides that the maximum amount reimbursed by the Zone from incremental tax revenue generated by the new development will be $1,238,068.
To support the City’s and the Zone’s efforts to improve public infrastructure, and the developers efforts to design and construct public infrastructure improvements, the Administration recommends that City Council approve the Agreement between the City, the Zone, East End On The Bayou, L.P.
