Summary:

ORDINANCE appropriating $1,417,681.29 out of Dedicated Drainage and Street Renewal Capital Fund – Ad Valorem Tax;  approving and authorizing first amendment to the Professional Engineering Services Contract between City of Houston and FCM ENGINEERS, P.C. for Antoine Paving and Drainage from Victory to West Gulf Bank (Approved by Ordinance No. 2017-0652); providing funding for CIP Cost Recovery relating to construction of facilities financed by the Dedicated Drainage and Street Renewal Capital Fund – Ad Valorem Tax - DISTRICT A - PECK

Background:

SUBJECT: First Amendment to Professional Engineering Services Contract between the City and FCM Engineers P.C. for Antoine Paving and Drainage from Victory to West Gulf Bank.

 

RECOMMENDATION: Approve First Amendment to the Professional Engineering Services Contract with FCM Engineers P.C and appropriate funds.

 

PROJECT NOTICE/JUSTIFICATION: This project is part of the Capital Improvement Plan (CIP) and is required to meet City of Houston standards as well as improve traffic circulation, mobility and drainage in the service area.

 

DESCRIPTION/SCOPE: This project consists of the design of approximately 5,400 linear feet of existing divided four-lane roadway to a four-lane divided roadway per Major Thoroughfare Freeway Plan (MTFP) standards.  The proposed reconstruction includes a four-lane divided concrete roadway with curbs, an efficient and cost effective underground drainage system to mitigate street flooding, new inlets, sidewalks, on street bicycle lanes, streetlights, signals, and necessary underground utilities.

 

LOCATION: The project area is generally bound by West Mount Houston Road on the north, West Little York Road on the south, T.C. Jester Boulevard on the east and Alabonson Road on the west. 

 

PREVIOUS HISTORY AND SCOPE:  City Council approved the original Contract on August 23, 2017 under Ordinance No. 2017-0652. The scope of services under the Original Contract consisted of Phase I - Preliminary Design Basic and Additional Services. Under this Contract, the Consultant accomplished Phase I - Preliminary Design Basic and Additional Services.

 

SCOPE OF THIS AMENDMENT AND FEE:  Under the scope of the First Amendment, the Consultant will accomplish the following: Phase II - Final Design and Phase III – Construction Phase Services. A fee of $990,434.25 is budgeted for Basic Services and $359,738.41 for Additional Services. The Additional Services are anticipated to include Right-of-Way Parcel Surveys, Drug Detection and Deterrence, Geotechnical Investigation and Report, Phase II Environmental Site Assessment, Traffic Control Plan (TCP), Storm Water Pollution Prevention Plan (SWPPP), Street Lighting Plan, Tree Protection Services, Traffic Signal Design, Texas Department of Licensing and Regulation (TDLR) Application/Permit, TDLR Review and Post Construction Inspection, Independent Quantity Take-off, Public Meetings, Reproduction Services, and Post Construction Geographic Information Systems (GIS) Deliverable.

 

The total requested appropriation is $1,417,681.29 to be appropriated as follows: $1,350,172.66 for contract services and $67,508.63 for CIP Cost Recovery.

 

PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides benefits for some employees but will pay into the Contractor Responsibility Fund for others, in compliance with City policy.

 

M/WBE PARTICIPATIONThe M/WBE goal established for this project is 24%.  The original Contract amount totals $560,312.52. The Consultant has been paid $542,434.51 (96.81%) to date. Of this amount, $179,440.00 (33.08%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $1,910,485.18.  The Consultant proposes the following plan to meet the M/WBE goal.
