SUBJECT: First Amendment to Professional Engineering Services Contract between the City and Omega Engineers, Inc., for Force Main Renewal and Replacement - Gulf Freeway #2 Lift Station.
RECOMMENDATION: Approve First Amendment to the Professional Engineering Services Contract with Omega Engineers, Inc., and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the City's ongoing force main renewal and replacement program.
The work to be performed under this contract award is necessary to maintain compliance with Houston's wastewater consent decree with EPA and TCEQ.
DESCRIPTION/SCOPE: This project consists of further testing and replacements of the valves and other components.
LOCATION: The project area is generally bound by Park Place on the north, Sims Bayou on the south, Galveston Road on the east and I-45 South on the west.
PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on July 19, 2017 under Ordinance No. 2017-0513. The scope of services under the Original Contract consisted of the evaluation and testing of the Force Main for condition assessment. Under this Contract, the Consultant completed the evaluation and testing of the Force Main for condition assessment.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the First Amendment, the Consultant will accomplish the following: Perform further evaluation and testing of the 42-inch force-main at various locations to determine its remaining useful life, replace all air release valves along the existing force-main, research and develop a more efficient and safe force-main operation and maintenance system, perform topographic survey and other additional services. A fee of $189,582.63 is budgeted for Basic Services and $214,882.00 for Additional Services.
The total requested appropriation is $424,688.00 to be appropriated as follows: $404,464.63 for contract services and $20,223.37 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project was 25.06%. The original Contract amount totals $364,950.00. The Consultant has been paid $303,950.00 (83.29%) to date. Of this amount, $4,500.00 (1.48%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $769,414.63. HPW has reviewed all the divisible areas on this contract, taking into account the findings in Phase I, and confirms that there are no additional divisible areas in the new scope. Accordingly, the prime will only be able to attain 11.50% participation on this project and has submitted good faith efforts documentation to OBO.
