SPECIFIC EXPLANATION: Robert Kness, Windrose Land Services, Inc., 3200 Wilcrest Drive, Suite 325, Houston, Texas, 77042, on behalf of CND-Long Point, LLC, (John Burchfield, General Counsel) and HT & Associates, Inc., (Bich-Ngoc T. Tran, President), requested the abandonment and sale of a 10-foot-wide water line easement, located within Tract 5A, out of the William Trott Survey, A-766. CND-Long Point, LLC, the property owner, plans to construct single family homes in the location of the subject water line easement. HT & Associates, Inc., the other abutting property owner, plans to incorporate its portion of the subject water line easement within the property as currently utilized. It was determined that no public utilities are located within the subject water line easement.
This is Part One of a two-step process in which the applicant will first receive a City Council authorized Motion acknowledging the concept of the subject request. Upon the applicant satisfactorily completing all transaction requirements including those enumerated below, the Department of Public Works and Engineering will forward a subsequent recommendation to City Council requesting passage of an Ordinance effecting the sale. The Joint Referral Committee reviewed and approved this request. Therefore, it is recommended:
- The City abandon and sell a 10-foot-wide water line easement, located within Tract 5A, out of the William Trott Survey, A-766;
- The applicant be required to furnish the Department of Public Works and Engineering with a durable, reproducible (Mylar) survey plat and field notes of the affected property;
- The Legal Department be authorized to prepare the necessary transaction documents; and,
- Inasmuch as the value of the City's property interest is not expected to exceed $50,000.00, that the value be established by staff appraisal, according to City policy.
