Summary:

RECOMMENDATION from Director Houston Public Works for approval of final contract amount of $4,093,924.56 and acceptance of work on contract with REPIPE CONSTRUCTION, LLC dba IPR SOUTH CENTRAL LLC for Sanitary Sewer Rehabilitation by Cured-In-Place Pipe Method (4258-67) - 4.69% over the original contract amount - DISTRICTS B - JACKSON and F - THOMAS

Background:

SUBJECT: Accept Work for Sanitary Sewer Rehabilitation by Cured-In-Place Pipe Method (LDS).

 

RECOMMENDATION: (Summary) Pass a motion to approve the final contract amount of $4,093,924.56, which is 4.69% over the original contract amount under the 5% contingency amount, accept the work, and authorize final payment.

 

PROJECT NOTICE/JUSTIFICATION: Under this project, the contractor provided sanitary sewer rehabilitation by cured-in-place pipe method to deteriorated sewer collection systems throughout the City.

 

DESCRIPTION/SCOPE: This project consisted of sanitary sewer rehabilitation by cured-in-place pipe method. The project was awarded to rePipe Construction, LLC dba IPR South Central, LLC with an original contract amount of $3,910,373.22. The Notice to Proceed date was 11/03/2016 and the project had 540 calendar days for completion.

 

LOCATION: This work order project was located at various locations within Council District B and F.

 

CONTRACT COMPLETION AND COST: The contractor, rePipe Construction, LLC dba IPR South Central, LLC, has completed the work under the contract. The contract was completed within the contract time with an additional 210 days approved by Change Order No. 2 and No. 4. The final cost of the project is $4,093,924.56, an increase of $183,551.34 or 4.69% over the original contract amount. More diversion pumping and traffic control were needed than anticipated.

 

The final amount of this work order contract was not affected by Change Order No. 1, No. 2, No. 3 and No. 4.

 

MWDBE PARTICIPATION:  The advertised M/WBE contract goals for this project were 12.94% MBE and 8.72% WBE (21.66% total). The M/WBE goals approved for this project were 12.94% MBE and 8.72% WBE (21.66% total). According to the Office of Business Opportunity, the actual participation achieved on this project was 13.06% MBE and 0.56% WBE (13.62% total). The standard for meeting MWBE participation goals is the demonstration of Good Faith Efforts. The Contractor’s M/WBE performance on this project was rated Satisfactory due to Good Faith Efforts for the following reasons: due to significant changes to the project, the work orders were comprised mostly of specialized technology work that could only be self-performed by the prime. Additionally, change orders eliminated the services slated to be provided by some goal credit subcontractors on the project. In one instance, change orders applied to the project because of emergency repairs to a 72-inch waterline caused major cost overruns that eliminated a substantial portion of the funding for this project. For the reasons listed, the Contractor's performance meets the intent and spirit of the City of Houston's MWBE program.
