RECOMMENDATION: Award construction contract and appropriate funds for the project.
SPECIFIC EXPLANATION: The General Services Department (GSD) recommends that City Council award a construction contract to Millis Development and Construction, LLC on the proposal amount of $1,750,249.00 to provide construction services for Hermann Square Renovation for the Houston Parks and Recreation Department. It is expected that private donations will reimburse the Reimbursement of Equipment/Project Fund.
PROJECT LOCATION: 900 Smith Street, Houston, TX 77002
PROJECT DESCRIPTION: The project consists of site improvements to the perimeter walkways at Hermann Square and City Hall and the addition of accessible ramps at all four corners of City Hall. The scope of work will include the demolition of existing paver sidewalks, and granite gravel along Walker, McKinney and Smith Streets; partial replacement of curb along McKinney Street, partial repair of curb and gutter along Smith Street; tree protection and treatment; installation of new concrete sidewalks and paver sidewalks; black star granite gravel around the existing trees; new pedestrian lighting, tree lighting and bollards. Utility boxes will be adjusted and the water line extended.
The contract duration for this project is 180 calendar days from the date of the Notice to Proceed.
Clark Condon Associates is the design consultant for this project.
PROPOSALS: On December 6 and December 13, 2019, GSD advertised a Request for Competitive Sealed Proposals (CSP) for construction services for Hermann Square Renovation. The CSP contained selection criteria that ranked respondents on experience, key personnel, safety and Hire Houston First. Eight firms responded. GSD evaluated the respondents and five of the eight firms received sufficient points and were requested to submit proposals. Three of the five shortlisted firms submitted proposals. Millis Development and Construction, LLC submitted the lowest proposal and offers the best value for the City based on the advertised criteria.

AWARD: It is recommended that City Council award the construction contract to Millis Development and Construction, LLC, and appropriate funds for the project, including an additional appropriation of $23,000.05 for engineering and materials testing services under an existing contract with Geotech Engineering and Testing.

PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s “Pay or Play” Ordinance regarding health benefits for employees of City contractors. In this case, the contractor elects to play; providing health benefits to eligible employees in compliance with City policy.
HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s ‘Hire Houston First’ (HHF) Ordinance that promotes economic opportunity for Houston businesses and supports job creation. In this case, Millis Development and Construction, LLC is a designated HHF company, but they were the successful awardee without application of the HHF preference.
CIP FISCAL NOTE: No significant Fiscal Operating impact is anticipated as a result of this project.
