SUBJECT: Interlocal Agreement between the City of Houston (City), Metropolitan Transit Authority of Harris County (METRO), and Harris County Flood Control District (HCFCD) for the Langham Creek Conveyance Improvement Project.
RECOMMENDATION: Adopt an ordinance approving and authorizing an Interlocal Agreement between the City of Houston, Metropolitan Transit Authority of Harris County and Harris County Flood Control District for the Langham Creek Conveyance Improvement Project.
PROJECT NOTICE/JUSTIFICATION: This Interlocal Agreement defines terms between the City, METRO, and HCFCD for the management of the preliminary engineering study and terms of the obligation of each project partner to pay an equal share of the total project cost.
DESCRIPTION: This project consists of the preparation and delivery of a preliminary engineering study to improve the conveyance capacity of Langham Creek by modifying the Clay Road bridge over Langham Creek. The Clay Road Bridge (The Bridge) is currently the only location that provides for the flow of water from Langham Creek into the Addicks Reservoir. The current span of the Bridge does not adequately convey storm water from the approximately two-mile floodplain upstream of Clay Road into the downstream Addicks Reservoir contributing to upstream flooding in extreme events.
LOCATION: The project area is Clay Road in the Addicks Reservoir, generally bound by War Memorial Street on the east and Bear Creek Drive on the west.
SCOPE OF THE AGREEMENT AND FEE: Under the scope of the Agreement, the City will be responsible for the preparation and delivery of the preliminary engineering study, with input from METRO and HCFCD. The City will utilize an existing professional engineering services contract with HDR, Inc., approved by City Council on April 23, 2014 under Ordinance 2014-0350 and Amended by Ordinance 2019-0353 on May 15, 2019, to conduct the study.
The total cost of the study is estimated to be $332,087.30. The City will pay for the study using funds previously appropriated for the contract with HDR, Inc. The HCFCD and METRO will each reimburse the City for one-third of the cost of the study, with each entity remitting an amount not to exceed $110,695.76.
Expenditures under the contract with HDR come from the Dedicated Drainage and Street Renewal Capital Fund-Drainage Charge (Fund 4042) and cause an automatic transfer of funds from the Dedicated Drainage and Street Renewal Fund-Drainage Charge (Fund 2310) when invoices are presented for payment. Consequently, reimbursement to the City of eligible study expenditures from amounts remitted by HCFCD and METRO will be deposited into Fund 2310.
FISCAL NOTE: No significant fiscal operating impact is anticipated as a result of this project.
ACTION RECOMMENDED: It is recommended that City Council adopt an ordinance approving and authorizing an Interlocal Agreement between the City of Houston, Metropolitan Transit Authority of Harris County, and Harris County Flood Control District.
