SUBJECT: Advance Funding Agreement between the City of Houston and Texas Department of Transportation (TxDOT) for Bridge Replacement or Rehabilitation Off the State System for Baca Street Bridge at HCFCD Ditch.
RECOMMENDATION: Adopt an ordinance approving and authorizing an Advance Funding Agreement between the City of Houston and TxDOT.
PROJECT NOTICE/JUSTIFICATION: The Federal Off-System Bridge Program is administered by TxDOT to replace or rehabilitate structurally deficient and functionally obsolete bridges located on public roads and streets not located in the designated state highway system.
DESCRIPTION: This project consists of rehabilitating or replacing the Baca Street Bridge at HCFCD Ditch.
LOCATION: The project area is generally bound by US 90 on the north, IH 10 on the south, Mercury Drive on the east and Oates Road on the west.
SCOPE OF THE AGREEMENT AND FEE: The Texas Administrative Code, Title 43, Section 15.55 provides that under specified conditions, the 10 percent local government match requirement may be waived if the local government performs an equivalent dollar amount of structural improvement work on another deficient bridge within its jurisdiction (Equivalent-Match Projects). The Texas Transportation Commission approved Minute Order No. 115005 dated August 31, 2017 for the reconstruction of the Baca Street Bridge listed below under the Federal Off-System Bridge Program, hereinafter, referred to as “Participation Waived” Project. City Council, under Resolution No. 2018-0017 dated March 7, 2018, approved the request for a waiver. Under Resolution No. 2020-0032 dated June 17, 2020, City Council amended Resolution No. 2018-0017 to correct the estimated amount of the local match participation. Transportation Commission Minute Order No. 115005 dated August 31, 2017 was superseded with Minute Order 115550 dated August 29, 2019.

The city proposes to replace the existing deficient wood bridge with a concrete culvert bridge. The new bridge will cost a total of approximately $562,650.00. The local match participation required for the reconstruction of the Participation-Waived bridge is $56,265.00
FISCAL NOTE: No significant fiscal operating impact is anticipated as a result of this project.
ACTION RECOMMENDED: It is recommended that City Council adopt an ordinance approving and authorizing an Advance Funding Agreement between the City of Houston and TxDOT.
