Summary:

ORDINANCE consenting to the addition of 0.92 acres of land to FORT BEND COUNTY MUNICIPAL UTILITY DISTRICT NO. 122, for inclusion in the district

Background:

SUBJECT: Petition for the City’s consent to the addition of 0.92 acres to Fort Bend County Municipal Utility District No. 122.

 

RECOMMENDATION: Petition for the City’s consent to the addition of 0.92 acres to Fort Bend County Municipal Utility District No. 122 be approved.

 

SPECIFIC EXPLANATION: Fort Bend County Municipal Utility District No. 122 (the “District”) was created through the TCEQ in 2000, and currently consists of 360.06 acres within Fort Bend County.  The District is within the extraterritorial jurisdiction of the City of Houston (the “City”) and has petitioned the City for consent to add 0.92 acres of vacant land, proposed be developed as commercial property, to the District.  The proposed annexation tract is located in the vicinity of Lakemont Bend Lane, South Mason Road, FM 1093, and Lakemont Bend Lane at FM 1093.  The addition of land to the District does not release it from the City’s extraterritorial jurisdiction.

 

The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.

 

The District has a wastewater collection system and treatment facility.  The annexation tract will be provided with wastewater treatment by the Fort Bend County Municipal Utility District No. 122 Wastewater Treatment Plant. This regional plant also provides wastewater treatment to Fort Bend County Municipal Utility District No. 123. Potable water is provided by the District.

 

The nearest major drainage facility for Fort Bend County Municipal Utility District No. 122 is Long Point Slough, which flows to Buffalo Bayou and then to the Houston Ship Channel. Long Point Slough is within the Buffalo Bayou watershed. The proposed annexation tract is not within the 100 or 500 year floodplain.

 

By executing the Petition for Consent, the District has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the District must be approved by the City prior to their construction.

   

The Utility District Review Committee recommends that the subject petition be approved.
