Summary:

ORDINANCE authorizing the sale of a variable width water line easement, a variable width access easement, and four temporary construction easements out of City fee-owned property to, NORTH HARRIS COUNTY REGIONAL WATER AUTHORITY (the “Authority”), in consideration of its payment to the City of $9,675.00 and other good and valuable consideration - DISTRICT A - PECK

Background:

 

SUBJECTOrdinance authorizing the sale and conveyance of: 1) a variable-width waterline easement; 2) a variable-width access easement; and 3) four temporary construction easements, all being out Restricted Reserve “B”, Block 2, Willowbrook Regional Wastewater Treatment Plant Subdivision, out of the W.H. York Survey, A-943. Parcels SY20-004A through SY20-004F

 

RECOMMENDATION: (Summary) It is recommended City Council approve an ordinance authorizing sale and conveyance of: 1) a variable-width waterline easement; 2) a variable-width access easement; and 3) four temporary construction easements, all being out Restricted Reserve “B”, Block 2, Willowbrook Regional Wastewater Treatment Plant Subdivision, out of W.H. York Survey, A-943. Parcels SY20-004A through SY20-004F

 

SPECIFIC EXPLANATIONMike Mahar, PAS Property Acquisition Services, LLC, 19855 Southwest Freeway, Suite 200, Sugarland, Texas on behalf of North Harris County Regional Water Authority, requested the sale and conveyance of : 1) a variable-width waterline easement; 2) a variable-width access easement; and 3) four temporary construction easements, all being out Restricted Reserve “B”, Block 2, Willowbrook Regional Wastewater Treatment Plant Subdivision, out of the W. H York, Survey, A-943.   The North Harris County Regional Water Authority needs to acquire the easements for the construction, operation, and maintenance of a water pipeline, the proposed route that crosses certain property owned by the City of Houston.  The Joint Referral Committee reviewed and approved this request.

 

Section 272.001(b)(5) of the Local Government Code, pertaining to the sale of real property interests to a governmental entity that has the power of eminent domain, provides for the payment of a consideration based upon the appraised fair market value.  North Harris County Regional Water Authority submitted its appraisal report with its purchase offer to the City.  A staff appraiser in Houston Public Works has reviewed the appraisal report and offer and finds it acceptable. Therefore, it is recommended City Council approve an ordinance authorizing:
