RECOMMENDATION:
Enact an ordinance approving and authorizing a non-exclusive, perpetual blanket easement for natural gas and related communications facilities between the City and CenterPoint Energy Resources Corp., d/b/a CenterPoint Energy Texas Gas Operations (CenterPoint), across certain premises at Ellington Airport (EFD) for the construction of utility connections for the Houston Spaceport Phase 1 Infrastructure Project.
SPECIFIC EXPLANATION:
In order to provide natural gas utility service to Houston Spaceport, CenterPoint requires the City to grant a non-exclusive, perpetual blanket easement for natural gas facilities and related communications facilities consisting of all necessary and desirable equipment and appurtenances.
Per authority granted to the Director of the Houston Airport System (HAS) by Chapter 9 of the City Code of Ordinances, the Director executed a Temporary Right-of-Entry for Construction of Facilities on September 6, 2019 authorizing the construction of the natural gas facilities within the proposed easement area while the permanent easement was being finalized for City Council approval.
In the future, the Director of HAS may request that the blanket easement be further defined and limited to the areas indicated by a future as-built, sealed survey of Houston Spaceport.
No monies are being exchanged for the easement because the granting of the easement is a condition for CenterPoint to provide natural gas utility service to Houston Spaceport.
